Motion no 173 Qu'on modifie le projet de loi C-12, par adjonction, après la ligne 13, page 127, du nouvel article suivant: «PARTIE VIII. 1 PRESTATIONS SPÉCIALES POUR LES PERSONNES QUI DEVIENNENT OU REDEVIENNENT MEMBRES DE LA POPULATION ACTIVE 153.1 (1) Malgré les autres dispositions de la présente loi, la Commission prend, avec l'agrément du gouverneur en conseil, les règlements qu'elle juge nécessaires visant l'établissement et le fonctionnement d'un régime assurant des prestations spéciales aux personnes qui deviennent ou redeviennent membres de la population active, au sens du paragraphe 7(4), notamment des règlements concernant: a) l'établissement des conditions requises pour recevoir des prestations, des règles d'admissibilité et d'exclusion, de la durée de l'admissibilité au bénéfice des prestations, du taux des prestations et des conditions liées au remboursement de prestations; b) l'adaptation des autres dispositions de la présente loi relativement aux personnes qui ont fait une demande en application de la présente partie et qui, subséquemment, en font une en application de la partie I ou VIII (2) Le régime établi par règlement peut, à l'égard de toute question, être différent des dispositions de la présente loi concernant cette question (3) Toutefois, le régime ne peut avoir pour effet d'assurer des prestations spéciales aux personnes qui n'ont pas exercé un emploi assurable pendant au moins sept cents heures au cours de leur période de référence ou qui sont visées par l'article 7.1».
' Motion No. 173 That Bill C-12 be amended by adding after line 16, on page 127, the following new Clause: ``PART VIII. 1 SPECIAL BENEFITS FOR NEW ENTRANTS AND RE-ENTRANTS TO THE LABOUR FORCE 153.1 (1) Notwithstanding anything in this Act, the Commission shall, with the approval of the Governor in Council, make such regulations as it deems necessary respecting the establishment and operation of a scheme to ensure that special benefits are provided to persons who are new entrants or re-entrants to the labour force within the meaning of subsection 7(4), including regulations (a) for establishing requirements to qualify to receive the benefits, the duration of entitlement to the benefits, benefit rates, disentitlement and disqualification from receiving the benefits and benefit repayment requirements; and (b) varying the application of any other provision of this Act in relation to persons who have made claims under this Part and who subsequently make claims under Part I or VIII (2) The scheme established by the regulations may, with respect to any matter, be different from the provisions of this Act relating to that matter (3) The scheme established by the regulations may not provide special benefits to persons who (a) have less than 700 hours of insurable employment in their qualifying period; or (b) are subject to an increase under section 7.1 in the number of hours of insurable employment required to qualify for benefits'.

M. Ronald J. Duhamel (secrétaire parlementaire du ministre des Travaux publics et des Services gouvernementaux) propose: Que, de l'avis de la Chambre, le gouvernement devrait étudier l'opportunité de présenter un projet de loi faisant en sorte que: a) toute personne qui, à un moment donné, a eu droit de recevoir une prestation en argent du gouvernement fédéral et qui n'a pas présenté de demande afin de recevoir cette prestation puisse la réclamer, que la demande soit prescrite ou non; b) sur réception de la demande, le gouvernement fédéral accorde cette prestation à la personne en cause s'il est convaincu que cette dernière y aurait eu droit si elle avait présenté sa demande dans les délais; c) la prestation porte intérêt selon les modalités déterminées par règlement du gouverneur en conseil.
Mr. Ronald J. Duhamel (Parliamentary Secretary to Minister of Public Works and Government Services) moved That, in the opinion of this House, the government should consider the advisability of introducing legislation that would ensure: (a) that any person who was once entitled to receive a monetary benefit from the federal government and did not make an application to receive such benefit, is allowed to file an application to receive the benefit, notwithstanding any limitation period affecting the application; (b) that, upon receipt of the application, the federal government shall grant such benefit to that person where it is satisfied that the person would have received the benefit had the person applied within the limitation period; and (c) that the monetary benefit bears interest as determined by regulation of the Governor in Council.
