Ce fut dès lors une surprise, tant pour le Conseil que pour la Commission et également, pour le Parlement et votre rapporteur d'être informé que dans son arrêt du 10 janvier 2006, la Cour de Justice annulait la décision du Conseil concernant l'approbation de la convention, disposant qu'il aurait fallu recourir à une double base juridique reposant tant sur les articles 133 et 175, premier paragraphe plutôt que sur le seul article 175, ou le seul article 133, comme le réclamait la Commission.
Both for the Council, the Commission and also for the Parliament and your rapporteur, it was therefore a surprise to be informed that on 10 January 2006, in its judgment, the Court of Justice annulled the Council Decision approving the Convention, ruling that there should have been a dual legal base including both Articles 133 and 175 first paragraph, instead of the sole Article 175, or the sole Article 133 which was requested by the Commission.
