Dans les cas où le médiateur a constaté un cas de mauvaise administration, il saisit l'institution, organe ou organisme concerné, qui dispose d'un délai de trois mois pour lui faire tenir son avis. Le médiateur transmet ensuite un rapport au Parlement européen et à l'institution, organe ou organisme concerné.
Where the Ombudsman establishes an instance of maladministration, he shall refer the matter to the institution, body, office or agency concerned, which shall have a period of three months in which to inform him of its views. The Ombudsman shall then forward a report to the European Parliament and the institution, body, office or agency concerned.

Notes that overall compliance with the Ombudsman’s recommendations stood at 80 % in 2012, slightly down from 82 % in 2011; supports the Ombudsman in her ambition to improve the compliance rate; urges the Commission, in particular, to make all efforts to improve its compliance rate; is concerned at the 20 % non-compliance rate, and urges the institutions, bodies, offices and agencies of the Union to respond and react within a reasonable timeframe to the critical remarks of the Ombudsman and to make all the necessary efforts to improve their follow-up rate through the prompt implementation of the Ombudsman’s recommendations and critical remarks; looks forward to the specific information that will be provided in the Ombudsman’s upcoming annual report on compliance in 2013;

17. félicite le Médiateur pour son travail de promotion des droits de l'homme, son ouverture à l'égard des personnes vulnérables et sa coopération avec les organisations de la société civile; déplore que le rapport annuel et les rapports spéciaux du Médiateur n'aient pas été discutés au parlement, de sorte qu'ils ne peuvent pas être publiés et qu'ils ne sont pas reconnus officiellement; exhorte le gouvernement et le parlement à renforcer la coopération avec le bureau du Médiateur; déplore que jusqu'à présent, le Médiateur n'ait pas été régulièrement informé ou consulté en temps voulu par le gouvernement sur les projets de loi pertinents; constate avec inquiétude que le budget alloué au bureau du Médiateur demeure insuffisant et a encore été réduit; souligne qu'afin de pouvoir continuer à remplir ses fonctions, cette institution doit bénéficier d'un soutien financier et politique plus important de la part du parlement et du gouvernement; demande l'organisation d'une vaste campagne de sensibilisation qui soulignerait le rôle et l'importance de cette institution;
17. Commends the Ombudsman for his work in promoting human rights, his openness towards vulnerable people and his cooperation with civil society organisations; deplores the fact that the Ombudsman’s annual and special reports have not been debated in the Parliament, and therefore cannot be published and are not officially acknowledged; urges the Government and the Parliament to improve cooperation with the office of the Ombudsman; deplores the fact that, so far, the Ombudsman has not regularly been informed or consulted by the Government in a timely manner on relevant draft legislation; notes with concern that the budget allocated to the Ombudsman’s office remains insufficient and has been further reduced; underlines the fact that the institution needs further financial and political support from both the Parliament and the Government in order to continue carrying out its duties; calls for a broad awareness campaign to highlight the role and importance of the institution;

In the first place, it is true that the special report from the Ombudsman to the European Parliament of 18 October 1999 (1004/97/(PD)GG), available on the Ombudsman’s web-page, contains a recommendation to the Commission to the effect that, at the latest from 1 July 2000 onwards, the Commission should give candidates access to their own marked examination scripts upon request, and that press release 15/2000 of 31 July 2000, cited by the applicant, available on the Ombudsman’s web-page states that ‘[t]he Commission accepted the Ombudsman’s recommendation with effect from July 2000’.

11. suggère qu'outre ceux de la Commission, des représentants de sa propre administration, de celle du Conseil et d'autres institutions, agences, services ou organes de l'Union qui ont fait l'objet d'une enquête, d'un rapport spécial, de commentaires critiques ou d'autres mesures prises par le médiateur, assistent à la réunion de la commission des pétitions au cours de laquelle le médiateur présente son rapport annuel, afin de pouvoir le commenter et participer au débat; demande donc instamment à sa propre administration, à celle du Conseil et des autres institutions, agences ou organes de l'Union concernés, d'être représentées lors des prochaines réunions consacrées à la présentation et à la discussion du rapport annuel du médiateur; croit que leur participation au débat et leur échange de vues sur la bonne administration et les difficultés surmontés à la suite de recommandations ou de commentaires du médiateur pourraient être bénéfiques à l'amélioration du service rendu aux citoyens, du dialogue interinstitutionnel et de l'instauration d'une véritable culture de service;
11. Suggests that when the Ombudsman presents his annual report in a meeting of the Committee on Petitions, not only representatives of the European Commission but also of the respective administrations of the European Parliament, the Council and other EU institutions, agencies, services and bodies that have been the subject of an investigation, a special report, critical remarks or other measures taken by the Ombudsman should be present to comment on the report and take part in the discussion; urges the administrations of Parliament, the Council and the other EU institutions, agencies and bodies concerned to be represented in future meetings when the Ombudsman's annual report is presented and discussed; believes that their participation in such discussions and the sharing of their views on good administration and on the problems overcome as a result of the European Ombudsman's recommendations and remarks could help to improve the service provided to EU citizens and interinstitutional dialogue and contribute to the establishment of a genuine service culture;

The Ombudsman may decide to prepare a special report to the European Parliament if the detailed opinion is not satisfactory.
