Dans ses conclusions du 12 décembre 2013 relatives au rapport de la Commission sur l'aide de l'Union européenne à la gouvernance démocratique, axé sur l'initiative relative à la gouvernance, le Conseil a noté que nonobstant les besoins de chaque pays partenaire et l'engagement pris par l'Union de fournir un financement prévisible, des éléments d'incitation dans la programmation peuvent favoriser les progrès et produire des résultats en termes de gouvernance démocratique, éléments qui devraient répondre de façon dynamique au niveau d'engagement et de progrès dans les domaines des droits de l'homme, de la démocratie, de l'État de droit et de la bonne gouvernance.
In its Conclusions of 12 December 2013 on the report from the Commission on EU Support for Democratic Governance, with a focus on the Governance Initiative, the Council noted that notwithstanding the partner country's needs and the commitment of the Union to provide predictable funding, elements of an incentive-based approach in programming can stimulate progress and results in democratic governance and should respond in a dynamic way to the level of commitment and progress with regards to human rights, democracy, the rule of law and good governance.

Commends the Ombudsman for his work in promoting human rights, his openness towards vulnerable people and his cooperation with civil society organisations; deplores the fact that the Ombudsman’s annual and special reports have not been debated in the Parliament, and therefore cannot be published and are not officially acknowledged; urges the Government and the Parliament to improve cooperation with the office of the Ombudsman; deplores the fact that, so far, the Ombudsman has not regularly been informed or consulted by the Government in a timely manner on relevant draft legislation; notes with concern that the budget allocated to the Ombudsman’s office remains insufficient and has been further reduced; underlines the fact that the institution needs further financial and political support from both the Parliament and the Government in order to continue carrying out its duties; calls for a broad awareness campaign to highlight the role and importance of the institution;

For the purposes of transparency and investor protection, Member States should require the following principles to apply to reporting on payments to governments in accordance with Chapter 10 of Directive 2013/34/EU: materiality (any payment, whether made as a single payment or a series of related payments, need not be taken into account in the report if it is below EUR 100 000 within a financial year); government and project-by-project reporting (reporting on payments to governments should be done on a government and project-by-project basis); universality (no exemptions, for instance for issuers active in certain countries, should be made which have a distortive impact and allow issuers to exploit lax transparency requirements); comprehensiveness (all relevant payments to governments should be reported, in line with Chapter 10 of Directive 2013/34/EU and supporting recitals).

In order to provide for enhanced transparency of payments made to governments, large undertakings and public-interest entities which are active in the extractive industry or logging of primary forests (9) should disclose material payments made to governments in the countries in which they operate in a separate report, on an annual basis.

Considers that any contact with the newly appointed Palestinian government should aim to achieve recognition of a final peace agreement based on a solution involving two viable states and the renunciation of violence by the government itself and the groups supporting it; believes the government's clarification regarding denouncing violence and recognition of Israel's right to exist and the Palestinians' international obligations to be crucial for any cooperation by the EU with it;

Despite the fact that the report takes account of the social repercussions of the prolonged economic and financial crisis, pleads in favour of rapid payment of EU financial aid to accompany reforms especially in the social sphere, especially as regards the establishment of the rule of law and the promotion of civil society and even though it considers the – admittedly increased – amount of aid granted to Turkey not yet to reflect the importance attached to Turkey's trade relations with the EU; and insists on the need for Turkey to equip itself with modern legislation on the right to strike and on collective negotiation, it is not for European governments or for the Turkish Government to determine the conditions for membership.

The pre-summit meeting between the Heads of State and Government in Ghent, other than the fact that, to my mind, it is a failure compared to the real summit, demonstrated that the Heads of State and Government give military cooperation with the United States priority over a concerted political approach at European Union level. It also relegates the humanitarian, diplomatic and all other types of initiatives to the background.
