Le 20 juillet 2010, la Commission avait déclaré que les nouveaux systèmes de financement des organismes publics nationaux de radiodiffusion France Télévisions, en France (IP/10/979), et RTVE, en Espagne (IP/10/978) étaient compatibles avec les règles de l'UE en matière d'aides d'État.
On 20 July 2010, the Commission cleared the compatibility of the new financing systems for national public television broadcasters France Télévisions (IP/10/979) and for the Spanish broadcaster RTVE (IP/10/978) with state aid rules.

Sans douter de la mission de service public de France Télévisions, la Commission a, dans un premier temps, considéré que le mode de calcul de la subvention annuelle attribuée à France Télévisions apparaissait comme proportionnel au sens de sa communication sur la radiodiffusion au vu de trois éléments : i) selon les affirmations de la France, le montant de la subvention était déterminée, avant chaque exercice, en fonction des coûts nets de service public de France Télévisions ; ii) ces affirmations étaient corroborées par les prévisions indicatives des ressources publiques, recettes et coûts de service public pour 2010 à 2012 ; iii) ce mode de calcul était cohérent avec l’engagement de la France pour que les ressources publiques allouées à France Télévisions n’excèdent pas le coût net d’exécution de service public à sa charge.
Without doubting the public service mission of France Télévisions, the Commission initially held that the method for calculating the annual subsidy allocated to France Télévisions seemed proportional in terms of its broadcasting communication in the light of three facts: (i) France states that the amount of the subsidy was determined before each financial year on the basis of the net public service costs of France Télévisions; (ii) those statements were supported by the indicative projections of public resources, revenue and public service costs for 2010 to 2012; (iii) that calculation method was consistent with France’s commitment that the public resources allocated to France Télévisions will not exceed the net cost of performing the public service obligations entrusted to the latter.

La Commission a considéré, dans un second temps, que le financement public de la mission de service public avait un caractère suffisamment transparent, vu que, premièrement, les mécanismes de contrôle établis par les dispositions françaises pertinentes étaient conformes aux exigences de transparence au sens de sa communication sur la radiodiffusion, deuxièmement, l’efficacité de ces mécanismes ressortait également des rapports annuels concernant France Télévisions, certifiés par des commissaires aux comptes, lesquels concluaient à l’absence d’une surcompensation et, troisièmement, la France avait entrepris des engagements afin de prévenir tout risque de surcompensation.
The Commission went on to hold that the public financing of the public service mission was sufficiently transparent, given that, first, the control mechanisms laid down by the relevant French provisions were consistent with the requirements of transparency in terms of its broadcasting communication, secondly, the effectiveness of those mechanisms was also apparent from the annual reports concerning France Télévisions certified by the auditors who had determined that there had been no overcompensation and, thirdly, France had given commitments designed to prevent any risk of overcompensation.

Le 20 juillet 2010, la Commission avait déclaré que les nouveaux systèmes de financement des organismes publics nationaux de radiodiffusion France Télévisions, en France (IP/10/979), et RTVE, en Espagne (IP/1O/978) étaient compatibles avec les règles de l'UE en matière d'aides d'État, notamment parce qu'ils n'entraînaient pas de distorsions de concurrence disproportionnées entre radiodiffuseurs publics et privés puisqu'il n'y aurait pas de surcompensation des coûts de la mission de service public.
On 20 July 2010, the Commission decided that the new financing systems in France and Spain for national public television broadcasters France Télévisions (IP/10/979) and RTVE (IP/10/978) respectively were compatible with EU state aid rules inter alia because they did not give rise to disproportionate distortions of competition between public and private broadcasters as there would be no over-compensation for the costs of their public service missions.

Il résulte de ce qui précède que les dotations budgétaires pour le seul groupe France Télévisions au moyen des ressources financières de l’État français, faussent ou, à tout le moins, menacent de fausser la concurrence qui s’exerce dans l’exploitation commerciale de la radiodiffusion en France et, dans une certaine mesure, dans d’autres États membres où les programmes de France Télévisions sont diffusés.
It follows from the above that the budget allocations by means of resources financed by the French State for the France Télévisions group only distort, or at the very least, threaten to distort competition in the commercial exploitation of broadcasting in France and, to a certain extent, in other Member States where the programmes of France Télévisions are broadcasted.

Au regard des informations fournies par la République française, cette appréciation positive sur la définition et le contrôle de la mission de service public de France Télévisions doit être étendue aux mécanismes applicables au lancement de services audiovisuels nouveaux importants, au sens de la communication sur la radiodiffusion entrée en application après la décision d’ouverture de la présente procédure.
From the point of view of the information supplied by the French Republic, this positive assessment on the definition and control of the public service mission of France Télévisions must be extended to the mechanisms applicable to the launch of significant new audiovisual services, within the meaning of the Broadcasting Communication which entered into effect after the decision initiating the present procedure.

Il apparaît donc en somme que la définition de la mission de service public dévolue à France Télévisions ainsi que les mécanismes de contrôle y afférents sont conformes aux règles et principes établis dans la communication sur la radiodiffusion, eux-mêmes inspirés par la jurisprudence des juridictions de l’Union.
To sum up, it therefore appears that the definition of the public service mission assigned to France Télévisions and the control mechanisms relating to it are in conformity with the rules and principles established in the Broadcasting Communication, which in turn were inspired by the case-law of the Union courts.

En outre, pour ce qui est des nouveaux services audiovisuels innovants mentionnés dans la communication sur la radiodiffusion, la République française souligne qu’un certain nombre est déjà prévu dans le nouveau cahier des charges de France Télévisions et le contrat d’objectifs et de moyens amendé, qui ont fait et feront l’objet des contrôles et consultations préalables et réguliers décrits ci-dessus.
In addition, as regards the new innovative audiovisual services mentioned in the Broadcasting Communication, the French Republic stresses that a certain number are already provided for in the new terms of reference of France Télévisions and the amended agreement relating to objectives and means, which have been and will be the subject of the prior, regular controls and consultations described above.

France Télévisions est active dans le domaine de la production et de la radiodiffusion de programmes qu’elle exploite commercialement, notamment en diffusant des publicités payantes pour des annonceurs ou des programmes parrainés dans sa programmation, en revendant ses droits de diffusion ou en achetant de tels droits.
France Télévisions operates in the field of the production and broadcasting of programmes which it exploits commercially, in particular by broadcasting paid advertising for advertisers or sponsored programmes in its programme schedule, by selling its broadcasting rights or by purchasing such rights.

Ensuite, le Tribunal juge que c’est à bon droit que la Commission a constaté que la dotation de 150 millions d’euros notifiée par la France était nettement inférieure aux coûts du service public de la radiodiffusion assuré par France Télévisions.
The Court then holds that the Commission was correct to state that the €150 million funding, notified by France, was significantly less than the costs of the public service broadcasting undertaken by France Télévisions.
