3. Member States shall take the necessary measures to ensure that, for the application of paragraphs 1 and 2 of this Article, information concerning the existence of criminal convictions for any of the offences referred to in Articles 3 to 7, or of any disqualification from exercising activities involving direct and regular contacts with children arising from those criminal convictions, is transmitted in accordance with the procedures set out in Council Framework Decision 2009/315/JHA of 26 February 2009 on the organisation and content of the exchange of information extracted from the criminal record between Member States (13) when requested under Article 6 of that Framework Decision with the consent of the person concerned.

Tout État membre fait en sorte que, à l’occasion d’une procédure pénale engagée contre une personne, des condamnations antérieures prononcées dans un autre État membre contre cette même personne pour des faits différents, pour lesquelles des informations ont été obtenues en vertu des instruments applicables en matière d’entraide judiciaire ou d’échange d’informations extraites des casiers judiciaires, soient prises en compte dans la mesure où des condamnations nationales antérieures le sont et où les effets juridiques attachés à ces condamnations sont équivalents à ceux qui sont attachés aux condamnations nationales antérieures conformément au droit interne.
1. Each Member State shall ensure that in the course of criminal proceedings against a person, previous convictions handed down against the same person for different facts in other Member States, in respect of which information has been obtained under applicable instruments on mutual legal assistance or on the exchange of information extracted from criminal records, are taken into account to the extent previous national convictions are taken into account, and that equivalent legal effects are attached to them as to previous national convictions, in accordance with national law.

This Article is based on the principle of simple assimilation of convictions and imposes as a matter of principle, that the legal effects of foreign convictions must be equivalent to the legal effect of domestic convictions ("principle of equivalence"), according to national law.

In contrast to other instruments, this Framework Decision does not aim at the execution in one Member State of judicial decisions taken in other Member States, but rather aims at enabling consequences to be attached to a previous conviction handed down in one Member State in the course of new criminal proceedings in another Member State to the extent that such consequences are attached to previous national convictions under the law of that other Member State.
