Senator Dyck: In referring to what Senator Campbell said, according to our information, the Joint Ministerial Advisory Committee — and I do not know whether that was in 2002 — advised that the ability of bands to establish their own leadership selection regimes, in other words hold their own elections, is likely an aboriginal right, a treaty right, or both; therefore, under the section 35 of the Constitution Act, 1982, it First Nations do have that right.
