Quant à la question de savoir si la Commission entend «dépasser définitivement la position rigide selon laquelle une fiscalité régionale/locale préférentielle est incompatible avec l’interdiction des aides d’État en vigueur dans la Communauté, en particulier en ce qui concerne les modalités de vérification du critère de la sélectivité territoriale», la Commission voudrait rappeler que, conformément à la récente jurisprudence dans les affaires des Açores et du Pays basque , une région est considérée comme étant «autonome» au sens des règles applicables aux aides d’État quand l’ensemble des trois critères concernant l’autonomie institutionnelle, procédurale ainsi qu’économique et financière est rempli.
As to the question whether the Commission intends "once and for all to abandon the inflexible view that regional and local tax concessions are incompatible with the Community ban on State aids, especially as regards the arrangements for determining regional selectivity", the Commission would like to recall that, according to the recent case-law in the Azores and Basque Countries cases, a region is considered as being "autonomous" within the meaning of State aid rules when all three criteria concerning the institutional, procedural and the economic and financial autonomy are fulfilled.
