Seventh plea in law, raised in support of the declaration of illegality, alleging that if Article 1(1) the Decision and Article 3(1) of the Regulation are to be interpreted so as to capture (a) any investigation by a Ukrainian authority irrespective of whether there is any judicial decision or proceedings underpinning, controlling or overseeing it; and/or (b) any ‘abuse of office as a public-office holder in order to procure an unjustified advantage’ irrespective of whether there is an allegation of misappropriation of State funds, the designation criterion would, given the arbitrary width and scope that would result from such a broad interpretation, lack a proper legal base; and/or be disproportionate to the objectives of the Decision and Regulation.

It deals with globalisation and liberalisation, raising the question of whether a general legislative framework should be established at Community level for services of general interest, and seeks to deal with these issues by asking questions about: the impact of any additional Community initiatives to implement the treaty, in full respect of the principle of subsidiarity; the principles likely to be incorporated in any framework legislation on services of general interest and the actual added value of legislation of that kind; the definition of good governance in the organisation, regulation, funding and evaluation of services of general interest; an examination of any new measure likely to be taken to increase legal certainty and facilitate consistent, harmonious coordination between the objective of safeguarding high-quality services of general interest and the rigorous application of the competition and internal market rules.

La portée de mon rapport dépend d’ailleurs en grande partie de la question de savoir si nous aurons aussi le courage d’adopter la proposition de la Commission concernant l'accès au marché des services portuaires sans la dénaturer en en excluant certains ensembles de services.

(31) Whether the consent to be obtained for the processing of personal data with a view to providing a particular value added service should be that of the user or of the subscriber, will depend on the data to be processed and on the type of service to be provided and on whether it is technically, procedurally and contractually possible to distinguish the individual using an electronic communications service from the legal or natural person having subscribed to it.
