4. À l'expiration du délai visé au paragraphe 3, si le demandeur n'a pas retiré sa demande et en cas de désaccord, la Commission décide quels sont les éléments des informations qui doivent rester confidentiels et, dans le cas où une décision est prise, elle en informe les États membres et le demandeur en conséquence.
4. After expiry of the period referred to in paragraph 3, if an applicant has not withdrawn the application and in case of disagreement the Commission shall decide which parts of the information are to remain confidential and, in case a decision has been taken, notify the Member States and the applicant accordingly.

The applicant and/or his supplier or suppliers, as appropriate, shall indicate to this Competent Body, which refrigerants and foaming agents have been used.With reference to criterion 5.4, the flame retardants that are used, if any, shall not have been assigned any of the above risk phrases nor shall they be named in Annex 1 to Directive 67/548/EEC or its subsequent amendments regarding the classification, packaging and labelling of dangerous substances.
