1. Le Conseil européen de Laeken, et c'est le grand mérite de la présidence belge d'avoir conduit à ce résultat, a donné à cette Convention un mandat dynamique, un mandat ouvert, et ainsi se trouve écarté le premier risque que j'avais imaginé ou craint : celui d'un mandat fermé, bloqué sur les quatre tirets de Nice, qui aurait provoqué ici même et chez moi une très grande déception et dans l'opinion également, et qui nous aurait contraints à un travail juridique, technique, sans perspectives politiques. Although some market actors tend to interpret this as meaning credit or deposit guarantees in the strictest sense (ie. banks only), it is clear from the context and from the discussions in the other institutions that this is meant to have a wider meaning, that is that a given MMI or the issuer thereof must be subject to either initial or ongoing supervision, eg. by a stock market regulator. Additionally, any other interpretation would render the following four indents would be completely superfluous.

Les personnes physiques qui, à la date de l'adoption de la présente directive, sont agréées dans un État membre pour offrir des services d'investissement sont considérées comme agréées au sens de la présente directive, à condition qu'elles remplissent les conditions visées à l'article 1er point 2 deuxième alinéa deuxième tiret et aux quatre tirets de l'article 1er point 2 troisième alinéa.
4. Natural persons authorized in a Member State on the date of the adoption of this Directive to offer investment services shall be deemed to be authorized under this Directive, provided that they fulfil the requirements imposed in Article 1 (2), second subparagraph, second indent, and third subparagraph, all four indents.
