Where a Member State, taking into account its application pursuant to Article 10c(5) of Directive 2003/87/EC and the relevant Commission Decision pursuant to Article 10c(6) of that Directive, issues the allowances to be granted free of charge on the basis of Article 10c of Directive 2003/87/EC irrespective of investments already undertaken (ex-ante issuance of allowances), the Member State should include in the national allocation table the allocation to be granted free of charge in accordance with Article 10c of Directive 2003/87/EC for the period 2013 to 2019, when notifying the national allocation table to the Commission pursuant to Article 51(1) of this Regulation.

Dans le but de déterminer les situations dans lesquelles des études d’efficacité postautorisation peuvent être requises conformément à l’article 9, paragraphe 4, point c quater), et à l’article 10 bis, paragraphe 1, point b), du présent règlement, la Commission peut, par voie d’actes délégués conformément à l’article 87 ter et sous réserve des conditions prévues aux articles 87 quater et 87 quinquies, adopter des mesures qui complètent les dispositions de l’article 9, paragraphe 4, point c quater), et de l’article 10 bis, paragraphe 1, point b).
1. In order to determine the situations in which post-authorisation efficacy studies may be required under point (cc) of Article 9(4) and point (b) of Article 10a(1) of this Regulation, the Commission may adopt, by means of delegated acts in accordance with Article 87b, and subject to the conditions of Articles 87c and 87d, measures supplementing the provisions in point (cc) of Article 9(4) and point (b) of Article 10a(1).

Where a Member State, taking into account its application pursuant to Article 10c(5) of Directive 2003/87/EC and the relevant Commission Decision pursuant to Article 10c(6) of that Directive, delays the issuance of the allowances to be granted free of charge on the basis of Article 10c of Directive 2003/87/EC (ex-post issuance of allowances), that Member State should include in its national allocation table pursuant to Article 51(1) of this Regulation the allocation to be granted free of charge on the basis of investments already undertaken or financial transfers already made at the time of the notification of the table.

The reports by the Commission to the European Parliament and to the Council referred to in Article 7b(7), Article 7c(2), Article 7c(9) and Article 7d(4) and (5), as well as the reports and information submitted pursuant to the first and fifth subparagraphs of Article 7c(3) and Article 7d(2), shall be prepared and transmitted for the purposes of both Directive 2009/28/EC and this Directive’.

The reports by the Commission to the European Parliament and to the Council referred to in Article 7b(7), Article 7c(2), Article 7c(9) and Article 7d(4) and (5), as well as the reports and information submitted pursuant to the first and fifth subparagraphs of Article 7c(3) and Article 7d(2), shall be prepared and transmitted for the purposes of both Directive 2009/28/EC and this Directive".

By way of derogation from the first subparagraph, Member States applying Article 28c shall calculate the amount of the payment each year by multiplying a figure corresponding to 25 % of the single area payment calculated in accordance with Article 28c by the number of eligible hectares the farmer has declared in accordance with Article 28c(1a).

On advice of the Agency, which will have consulted relevant stakeholders, the Commission shall draw up strategic guidelines for the European Network of Transmission System Operators for Electricity covering the issues listed in Article 2c(1)(c) and Article 2c(3), from which the European Network of Transmission System Operators for Electricity will prepare codes in the areas listed in Article 2c(1)(c) and Article 2c(3).
