(2) Where any of the costs determined under subsection (1) are affected by start-up operations that limit the level of production associated with the initial phases of commercial production owing to technical difficulties during the start-up period of production that are related to the use of new production facilities or the production of a new or substantially different product, the affected costs shall be adjusted on the basis of the costs that exist at the end of the start-up period of production or, if the period extends beyond the investigation period, on the basis of the costs that exist at the end of that period.

With regard to the reiterated argument that the recent change in the exchange rate between USD and EUR led to a significant increase in the price of the imported PET and consequently the Union industry allegedly does not need to be granted protection by trade defence measures, it is noted that any anti-subsidy investigation normally does not take into account the post IP developments; unless, in extraordinary situations, it can be shown, inter alia, that they are of a lasting nature and would significantly alter the findings of the case.

Sur la base de ce qui précède, il est provisoirement conclu que les importations à bas prix faisant l'objet d'un dumping en provenance des États-Unis, qui ont sensiblement sous-coté les prix pratiqués par l'industrie communautaire pendant la période d'enquête et dont les volumes ont connu une croissance considérable, ont joué un rôle déterminant dans le préjudice subi par l'industrie communautaire, qui s'est notamment traduit par la détérioration de sa situation financière au cours de la période d'enquête.
Based on the above, it is provisionally concluded that the low-priced dumped imports from the USA, which significantly undercut the prices of the Community industry during the IP and which also significantly increased in volume, have had a determining role in the material injury suffered by the Community industry, which is reflected in particular in the deterioration of its financial situation during the IP.

Among the amendments that have been tabled, I should like to highlight the following amendments for their importance to the economy as distinct from what I feel should be subject to a formal framework decision: greater harmonisation of the conditions of access to biometric databases, ensuring that such access is limited to investigations, and, in the case of fingerprint data, to the prevention of serious criminal offences; clear definition of rules applying to joint operations; establishment of strict necessity criteria so that the transmission of personal data is legitimate, especially when it comes to the most delicate situations, major events and preventing terrorist attacks; extending the scope of the chapter on data protection to all forms of processing data, ensuring compliance with all recommendations put forward by the European data protection supervisor; implementation of a maximum period for keeping personal data; establishment of specific safeguards prohibiting the processing of sensitive data that may be used for the purpose of ethnic profiling; strengthening Parliament’s role in following up the proposal for a decision, in particular when implementation and assessment measures are adopted; and lastly, clarification of the relationship between this proposal for a decision and the proposal for a framework decision on data protection under the third pillar, the latter always being a general regulatory framework in the matter, in any situation.
