IN-CONTEXT TRANSLATIONS

L'article 14 du Pacte international relatif aux droits civils et politiques (PIDCP) prévoit que "toute personne accusée d'une infraction pénale est présumée innocente jusqu'à ce que sa culpabilité ait été légalement établie et a le droit d'assister à son procès et de se défendre elle-même ou d'avoir l'assistance d'un défenseur de son choix".
Article 14 of the International Covenant on Civil and Political Rights (the ICCPR) stipulates that "everyone charged with a criminal offence shall have the right to be presumed innocent until proved guilty according to law" and establishes "the right to be tried in his presence, and to defend himself in person or through legal assistance of his own choosing".

A. considérant que le procureur général de la République de Pologne a transmis une demande d'autorisation du parquet de district de Varsovie d'engager des poursuites pénales contre Janusz Korwin-Mikke, député au Parlement européen, en ce qui concerne le délit visé à l'article 222, paragraphe 1, du code pénal polonais; considérant, en particulier, que les poursuites portent sur une atteinte présumée à l'intégrité physique d'un fonctionnaire;
A. whereas the Prosecutor-General of the Republic of Poland has forwarded a request from the District Prosecutor’s Office in Warsaw for authorisation to bring criminal proceedings against a Member of the European Parliament, Janusz Korwin-Mikke, with regard to an offence under Article 222(1) of the Polish Criminal Code; whereas, in particular, the proceedings concern the alleged infringement of the physical integrity of a public official;

A. considérant que le procureur général adjoint de la République portugaise a transmis la demande de levée de l'immunité parlementaire d'Ana Gomes, présentée par un procureur du Service des enquêtes et poursuites pénales de Lisbonne en lien avec des déclarations diffamatoires présumées formulées par M Gomes au cours d'un débat télévisé; considérant que la demande a été présentée de sorte que des poursuites pénales puissent être engagées à l'encontre de M Gomes et que cette dernière puisse être interrogée dans le contexte desdites procédures;
A. whereas the Deputy Attorney General of the Portuguese Republic has forwarded the request for the waiver of the parliamentary immunity of Ana Gomes, made by a public prosecutor of the Lisbon Department of Investigation and Criminal Proceedings in connection with allegedly defamatory statements made by Ms Gomes during a television debate; whereas the request has been made so that criminal proceedings may be instituted against Ms Gomes and the latter may be questioned in the context of those proceedings;

A description of the facts, including, where known, time and place, relating to the criminal act that the persons are suspected or accused of having committed and the possible legal classification of the alleged offence should be given in sufficient detail, taking into account the stage of the criminal proceedings when such a description is given, to safeguard the fairness of the proceedings and allow for an effective exercise of the rights of the defence.
