IN-CONTEXT TRANSLATIONS

considérant que la procédure engagée à titre posthume à l'encontre de Serguei Magnitsky constitue une violation du droit international et du droit national et qu'elle montre clairement le mauvais fonctionnement de la justice pénale russe;
whereas the posthumous prosecution of Sergei Magnitsky is a violation of international and national laws and clearly shows the malfunctioning of the Russian criminal justice system;

2. réaffirme "les perspectives européennes" des pays des Balkans occidentaux, qui ont été clairement esquissées au cours du Conseil européen de Thessalonique; souligne néanmoins que l'adhésion future des pays des Balkans occidentaux à l'Union est rigoureusement subordonnée au respect de toutes les conditions et exigences fixées par l'Union européenne, y compris les critères d'adhésion de Copenhague et au parachèvement du processus de stabilisation et d'association, qui englobe la coopération régionale, de bonnes relations entre pays voisins et la coopération sans réserve avec le Tribunal pénal international pour l'ex-Yougoslavie;
2. Reiterates "the European perspective" of the countries of the Western Balkans which was clearly formulated during the Thessaloniki European Council; points out, however, that the future accession of the Western Balkan countries to the European Union is strictly conditional on the fulfilment of all the conditions and requirements set by the European Union, including the Copenhagen membership criteria and the successful fulfilment of the Stabilisation and Association Process, which includes regional cooperation, good neighbourly relations and full cooperation with the International Criminal Tribunal for the former Yugoslavia;

Toutefois, rares sont sans doute ceux d’entre nous qui nieront que le maintien de la primauté du droit au niveau international représente l’un des principes de l’Union européenne. À cet égard, il doit être établi que la Croatie a respecté le droit international et ses obligations envers le Tribunal pénal international clairement définies par ce droit, non seulement dans l’intérêt de l’Union, mais également dans celui, plus général, de tous ceux d’entre nous qui souhaitent que le droit international soit appliqué au sein des Balkans occidentaux dans leur ensemble.
In that regard it is important that Croatia is recognised to have upheld international law and its clear obligations to the International Criminal Tribunal under international law, not just in the interests of the Union but also in the more general interests of all of us who wish to see international law upheld within the western Balkans generally.

4. exprime l'espoir qu'un gouvernement fort et clairement pro-européen pourra être formé prochainement en Serbie, qui sera sérieusement et positivement engagé dans la recherche d'une solution à la question du statut du Kosovo; souligne qu'un tel gouvernement est également nécessaire aux fins d'une pleine coopération avec le Tribunal pénal international pour l'ex-Yougoslavie et permettra, dans ces conditions, la réouverture des négociations sur un accord de stabilisation et d'association entre la Serbie et l'Union européenne et sur la conclusion finale de cet accord;

Expresses the hope that a strong and clearly pro-European government can be formed soon in Serbia, which will be seriously and positively engaged in seeking a solution to the question of the status of Kosovo; emphasises that such a government is also necessary for the purposes of full cooperation with the International Criminal Tribunal for the former Yugoslavia and will allow, under these conditions, for the re-opening of the negotiations on, and the final conclusion of, a Stabilisation and Association Agreement between Serbia and the European Union;

I also have problems regarding the United States position on the International Criminal Court. The same is true of other European states. I believe the text of the agreement should make it clear that a request submitted by the International Criminal Court takes precedence over one submitted by a third country.

Parliament has clearly provided, through its enactment of the Crimes against Humanity and War Crimes Act, that no one may claim immunity from arrest or extradition in Canada if they are subject to a request for surrender by the International Criminal Court or a tribunal treated by a United Nations Security Council resolution named in the schedule to the Extradition Act, currently the international criminal tribunals for the former Yugoslavia and Rwanda.
