TRADUCTIONS EN CONTEXTE

Le ministre de la justice, le CSM et la Haute Cour de cassation et de justice doivent mettre la dernière main à un plan d'action pour que le nouveau délai de mise en œuvre des dispositions restantes du code de procédure civile puisse être respecté; afin d'améliorer davantage la transparence et la prévisibilité du processus législatif, et de renforcer les garde-fous internes dans l'intérêt de l'irréversibilité des résultats, le gouvernement et le Parlement doivent garantir la transparence totale et tenir dûment compte des consultations avec les autorités concernées et les parties prenantes dans le cadre du processus décisionnel et des activités législatives relatives au code pénal et au code de procédure pénale, aux lois sur la corruption, aux lois sur l'intégrité (incompatibilités, conflits d'intérêts, enrichissement injustifié), aux lois de la justice (concernant l'organisation du système judiciaire), ainsi qu'au code civil et au code de procédure civile, en s'inspirant de la transparence du processus décisionnel mis en place par le gouvernement en 2016; le gouvernement doit mettre en place un plan d'action adéquat visant à traiter le problème posé par l'exécution des décisions de justice et l'application de la jurisprudence des cours et tribunaux par l'administration publique, comprenant notamment un mécanisme fournissant des statistiques exactes pour permettre le suivi de ces questions à l'avenir.
The Minister of Justice, the SCM and the High Court of Cassation and Justice should finalise an action plan to ensure that the new deadline for the implementation of the remaining provisions of the Code of Civil Procedures can be respected. In order to improve further the transparency and predictability of the legislative process, and strengthen internal safeguards in the interest of irreversibility, the Government and Parliament should ensure full transparency and take proper account of consultations with the relevant authorities and stakeholders in decision-making and legislative activity on the Criminal Code and Code for Criminal Procedures, on corruption laws, on integrity laws (incompatibilities, conflicts of interest, unjustified wealth), on the laws of justice (pertaining to the organisation of the justice system) and on the Civil Code and Code for Civil Procedures, taking inspiration from the transparency in decision-making put in place by the Government in 2016. The Government should put in place an appropriate Action Plan to address the issue of implementation of court decisions and application of jurisprudence of the courts by public administration, including a mechanism to provide accurate statistics to enable future monitoring.

Underscores the need to strengthen the international criminal justice system and in this respect recognises the establishment of the Justice Rapid Response mechanism in November 2007 as a new international cooperative mechanism for the provision of expertise and assistance where the identification, collection and preservation of information would assist in a wide range of international and transitional justice options; urges the ICC to intensify its outreach efforts with a view to engaging communities in situations under investigation in a process of constructive interaction with the ICC, designed to promote understanding and support for its mandate, to manage expectations and to enable those communities to follow and understand the international criminal justice process; highlights the role that can be played by non-judicial mechanisms in addressing violations of human rights and international criminal law, provided that such efforts respect due process and are not a sham;

Urges all Member States to collaborate fully in international criminal justice mechanisms, and especially in bringing fugitives to justice; in this regard, notes with satisfaction the cooperation of the Democratic Republic of the Congo in the transfer of Germain Katanga to the ICC, the cooperation of Serbia in the arrest and transfer of Zdravko Tolimir to the International Criminal Tribunal for the former Yugoslavia (ICTY) and the cooperation of Serbia and Montenegro in the arrest and transfer of Vlastimir Đjorđjević to the ICTY; however, notes with concern the persistent failure of Sudan to cooperate with the ICC by arresting and transferring Ahmad Muhammad Harun and Ali Muhammad Ali Abd-Al-Rahman; notes with concern that the ICC warrants for the arrest of four members of the Lord's Resistance Army in Uganda have not yet been executed; also notes with concern that Radovan Karadžić and Ratko Mladić remain at large and have not been brought before the ICTY; in this regard, calls on the Serbian authorities to ensure full cooperation with the ICTY, which should lead to the arrest and transfer of all remaining indictees, in order to open the way to the ratification of a Stabilisation and Association Agreement; considers further that the current proceedings brought against Liberia's former President, Charles Taylor, by the Special Court for Sierra Leone in The Hague constitute a significant development towards the ending of impunity;

RAPPELANT les conventions des Nations unies pour la lutte contre le terrorisme et son financement, ainsi que les résolutions pertinentes du Conseil de sécurité dans le domaine de la lutte contre le terrorisme, en particulier la résolution 1373 (2001) du Conseil de sécurité des Nations unies et ses directives, qui disposent que tous les États prennent les mesures nécessaires pour empêcher la perpétration d’actes de terrorisme, y compris en assurant l’alerte rapide des autres États grâce à l’échange d’informations, que les États se prêtent mutuellement la plus grande assistance lors des enquêtes criminelles ou procédures pénales portant sur le financement d’actes de terrorisme ou l’appui dont ces actes ont bénéficié, que les États devraient trouver des moyens d’intensifier et d’accélérer l’échange d’informations opérationnelles, que les États devraient échanger des informations conformément au droit international et au droit national, et que les États devraient coopérer, en particulier au moyen d’accords bilatéraux et multilatéraux, afin d’empêcher et de supprimer les attentats terroristes et de prendre des mesures contre les auteurs de ces attentats.
RECALLING the United Nations conventions for combating terrorism and its financing, and relevant resolutions of the United Nations Security Council in the field of fighting terrorism, in particular United Nations Security Council Resolution 1373 (2001) and its directives that all States shall take the necessary steps to prevent the commission of terrorist acts, including by provision of early warning to other States by exchange of information; that States shall afford one another the greatest measure of assistance in connection with criminal investigations or criminal proceedings relating to the financing or support of terrorist acts; that States should find ways of intensifying and accelerating the exchange of operational information; that States should exchange information in accordance with international and domestic law; and that States should cooperate, particularly through bilateral and multilateral arrangements and agreements, to prevent and suppress terrorist attacks and to take action against perpetrators of such attacks.

6. demande aux Nations unies et à l'Union européenne d'étudier les travaux réalisés à ce jour par le Tribunal pénal international afin de pouvoir évaluer s'il est ou non nécessaire d'accorder au tribunal des ressources supplémentaires à titre temporaire, afin de lui permettre de conclure les enquêtes et les procès relatifs aux personnes suspectées de génocide;
6. Calls on the UN and the EU to evaluate the work done so far by the International Court, so that an assessment can be made to determine if additional resources are required, with time limitation, for the Court to conclude the investigations and the trials of the genocide suspects;
