to fully implement the judgments of the Constitutional Tribunal of 3 and 9 December 2015 which requires that the three judges lawfully nominated in October 2015 can take up their function; to publish and fully implement all the judgments of the Constitutional Tribunal, including those of 9 March and 11 August 2016 concerning the Law on the Constitutional Tribunal; to ensure that any reform of the Law on the Constitutional Tribunal respects the judgments of the Constitutional Tribunal, takes the Opinion of the Venice Commission fully into account and ensures that the effectiveness of the Constitutional Tribunal as a guarantor of the Constitution is not undermined; to refrain from actions and public statements which could undermine the legitimacy and efficiency of the Constitutional Tribunal.

Believes that extending the exemplary role of public buildings to all levels of public administration, and not just central government, will help fully tap the cost-effective potential of buildings, since this has been proven to be the sector with the highest potential, not only for energy savings, but also for delivering other wider benefits, including increased comfort and wellbeing; considers in this respect that Member States should be required to establish an internal mechanism for sharing achievement of the 3 % renovation target between the different public administration levels, and that the flexibility to opt for other measures should be maintained and their impact quantified, as an alternative approach to paragraphs 1 and 2.

Commends the work of independent regulatory bodies and their contribution to improving the legal framework and accountability of state institutions; underlines that state institutions must act in a transparent and accountable manner; supports the work of independent state authorities such as the Ombudsman, the Commissioner for Information of Public Importance, and others; calls on the state authorities to protect the independence of these offices and fully cooperate with them when they exercise their powers; considers that the authorities should provide them with all financial and administrative resources necessary for their work; stresses that their recommendations need to receive proper follow-up and their independence needs to be fully respected;

12. souligne la nécessité de créer une administration publique professionnelle et fondée sur le mérite qui opère en toute transparence et soit en mesure d'adopter des lois et de les mettre en œuvre; demande l'adoption du droit dérivé nécessaire à la mise en œuvre adéquate de la loi sur la fonction publique, ainsi que l'élaboration d'une nouvelle loi sur les procédures administratives générales; souligne la nécessité de renforcer les services de l'administration publique et de disposer d'un système de gestion informatisé des ressources humaines pleinement opérationnel; insiste sur le fait que des efforts plus poussés sont nécessaires pour dépolitiser l'administration publique, lutter contre la corruption, renforcer la méritocratie dans les procédures de nomination, les promotions et les licenciements, ainsi qu'améliorer son efficacité et sa viabilité financière;
12. Stresses the need to create a merit-based and professional public administration which operates transparently and is able to adopt laws and implement them; calls for the adoption of the necessary secondary legislation to ensure the proper implementation of the Civil Service Law, and for a new Law on General Administrative Procedures; stresses the need for a stronger Department of Public Administration as well as for a fully operational Human Resources Management Information System; underlines the fact that further efforts are needed to depoliticise public administration, fight corruption, strengthen meritocracy in appointments, promotions and dismissals and increase the efficiency and financial sustainability of public administration;

8. appelle l'Albanie à mettre en œuvre la loi sur la fonction publique sans retard et de manière efficace, à adopter la loi sur la procédure administrative générale en temps utile et à améliorer la loi sur l'organisation et le fonctionnement de l'administration publique; souligne la nécessité de renforcer les services de l'administration publique et de disposer d'un système de gestion informatisé des ressources humaines pleinement opérationnel;
8. Calls on Albania to implement the Civil Service Law in a timely and efficient manner, adopt the Law on General Administrative Procedure in due course and enhance the Law on the Organisation and Functioning of Public Administration; stresses the need for a stronger Department of Public Administration and a fully operational Human Resources Management Information System;

B. considérant que la participation des citoyens au processus décisionnel est un élément essentiel de la gouvernance démocratique et que les consultations publiques bien conçues sont des outils importants afin de permettre aux citoyens et aux autres acteurs de la société de participer pleinement à ce processus et de faire avancer la politique de l'Union européenne en matière de transparence; considérant qu'à ce jour, le potentiel des consultations publiques à combler le manque de communication et d'information entre les citoyens et l'Union n'a pas été pleinement exploité;
B. whereas citizens’ involvement in the decision-making process is a key element in democratic governance, and whereas well thought-out public consultations are important tools to use in ensuring that citizens and other parts of society are able to participate fully in that process, and in making headway with the European Union’s policy on transparency; whereas the potential of public consultations to bridge the communication and information gap between the citizens and the EU has not yet been fully exploited;

Ensuite, il a affirmé que le refus de la Commission de communiquer, même au seul Tribunal de la fonction publique, ces éléments d’information a eu comme conséquence de ne pas permettre à celui-ci d’exercer pleinement son contrôle (point 51 de l’arrêt attaqué).
Furthermore, it stated that the Commission’s refusal to communicate, even to the Civil Service Tribunal alone, those items of information meant that the Tribunal could not exercise properly its power of judicial review (paragraph 51 of the judgment under appeal).

En cinquième lieu, le Tribunal de la fonction publique a tiré les conséquences de la présence de ces circonstances particulières et jugé que, si la communication au requérant de la note individuelle éliminatoire qu’il a reçue à l’épreuve orale, à savoir 24,5/50, constituait plus qu’un simple début de motivation pour lequel, selon la jurisprudence (arrêt du Tribunal du 6 novembre 1997, Berlingieri Vinzek/Commission, T‑71/96, RecFP p. I‑A‑339 et II‑921, point 79), des précisions complémentaires pouvaient être apportées en cours d’instance, en revanche, cette seule note n’était pas suffisante, dans les circonstances de l’espèce, pour satisfaire pleinement à l’obligation de motivation.
Fifthly, the Civil Service Tribunal held, in consequence of the existence of those special circumstances, that although the communication to the applicant of the individual eliminatory mark, of 24.5 out of 50, which he received in the oral test constitutes more than merely the initial elements of a statement of reasons which, according to the case-law (Case T‑71/96 Berlingieri Vinzek v Commission [1997] ECR-SC I‑A‑339 and II‑921, paragraph 79), was susceptible of being supplemented by further information provided during the proceedings, that mark alone not being sufficient, in the particular circumstances, to satisfy fully the obligation to state reasons.
