Definition: Personality change, persisting for at least two years, attributable to the traumatic experience of suffering from a severe psychiatric illness. The change cannot be explained by a previous personality disorder and should be differentiated from residual schizophrenia and other states of incomplete recovery from an antecedent mental disorder. This disorder is characterized by an excessive dependence on and a demanding attitude towards others; conviction of being changed or stigmatized by the illness, leading to an inability to form and maintain close and confiding personal relationships and to social iso-lation; passivity, reduced interests, and diminished involvement in leisure activities; persistent complaints of being ill, which may be associated with hypochondriacal claims and illness behaviour; dysphoric or labile mood, not due to the presence of a current mental disorder or antecedent mental disorder with residual affective symptoms; and longstanding problems in social and occupational functioning.

iii. to defend the inclusion of a regulatory annex on government procurement with a view to maximising the participation of European companies in foreign tenders, while maintaining EU criteria, including social and environmental criteria, and procedures in European tenders, notably regarding SMEs’ access to public contracts, the eligibility criteria based on the best ‘quality-price’ ratio and the thresholds below which commitments do not apply; to overcome the lack of transparency and market entry barriers regarding non-European calls for tenders and to denounce the lack of reciprocity in this area at all levels of government, as illustrated by the preferential treatment granted to domestic companies in several countries, while allowing for the possibility of opting for market access and national treatment commitments for the sake of multilateralisation; to encourage the ratification and implementation by those parties who have not yet done so of the WTO Government Procurement Agreement and its 2011 revision; to call on the European Union to introduce a ‘European Business Act’, modelled on the ‘American Business Act’ and supporting the economic development of SMEs and European industry;

xxi) sachant que les entreprises européennes, et les PME singulièrement, souhaitent vivement pouvoir accéder sans discrimination aux marchés publics aux États-Unis, à l'échelle fédérale et infra-fédérale, par exemple dans le domaine de la construction, du génie civil, des infrastructures de transport et d'énergie et des biens et services, défendre une position ambitieuse sur le chapitre des marchés publics, tout en veillant à la conformité du chapitre avec les nouvelles directives de l'Union en matière de marchés publics et de contrats de concession, afin de remédier, conformément au principe de réciprocité, à la grande disparité existant actuellement dans le degré d'ouverture des deux marchés des commandes publiques de part et d'autre de l'Atlantique en ouvrant sensiblement le marché américain (qui reste régi par le Buy American Act de 1933) aux niveaux fédéral et infra-fédéral dans le prolongement des engagements pris dans l'Accord sur les marchés publics (AMP) et en mettant fin aux restrictions actuellement en vigueur au niveau de la fédération, des États et de l'échelon local aux États-Unis; et mettre en place des mécanismes propres à garantir que les engagements pris au niveau fédéral par les États-Unis seront honorés à tous les niveaux politiques et administratifs;
(xxi) given the huge interest on the part of European companies, notably SMEs, in obtaining non-discriminatory access to public contracts in the US both at federal and sub-federal level, for example for construction services, civil engineering, transport and energy infrastructure and goods and services, to have an ambitious approach to the chapter on public procurement, while respecting the compliance of the chapter with the new EU public procurement and concession directives, with a view to remedying, in line with the principle of reciprocity, the large disparity that currently exists in the degree of openness of the two public procurement markets on both sides of the Atlantic by significantly opening up the US market (still governed by the Buy American Act of 1933) at federal and sub-federal level alike building on commitments made in the Agreement on Government Procurement (GPA) and by removing the restrictions that currently apply at federal, state and local level alike in the United States; and to set up mechanisms to guarantee that commitments entered into by the US federal authorities will be honoured at all political and administrative levels;

R. considérant que les accords de libre-échange conclus par l'Union comportent des dispositions permettant à des entreprises de soumissionner pour des PPP au moyen d'engagements d'accès au marché et d'engagements avant établissement; que la démarche et les possibilités envisageables par rapport à la Corée, la Colombie et le Pérou, l'Amérique centrale, Singapour et le Canada (ainsi que le Vietnam et le Japon) sont définies différemment et spécifiquement; qu'une certaine souplesse est nécessaire dans les négociations avec différents partenaires; que l'objectif doit néanmoins toujours être de contribuer à un développement social, économique et environnemental durable, à la démocratie et à la bonne gouvernance, au respect des droits de l'homme et à la promotion des règles de protection internationalement reconnues, y compris la création d'emplois décents; qu'au niveau multilatéral, l'accord général sur le commerce des services (AGCS) et l'accord sur les marchés publics (AMP) établissent également un certain nombre d'engagements, à l'instar d'autres instruments plurilatéraux, comme l'accord sur le commerce des services (ACS); que l'environnement de l'Union devient, par conséquent, plus concurrentiel;
R. whereas EU free trade agreements include provisions which pave the way for companies to bid in PPPs via market access and pre-establishment; whereas the treatment and possibilities open in respect of Korea, Colombia/Peru, Central America, Singapore and Canada (and Vietnam and Japan) are defined differently and specifically; whereas there has to be a relatively flexible approach as regards negotiations with different partners; whereas, however, the aim must continue to be to help foster social and economic development, environmental sustainability, democracy and good governance, the observance of human rights and the promotion of internationally recognised standards of protection, as well as the creation of decent jobs; whereas, at the multilateral level, the General Agreement on Trade in Services (GATS) and the Agreement on Government Procurement (GPA) also establish a number of commitments, as may other plurilateral instruments such as the Trade in Services Agreement (TiSA); whereas the environment in the EU is therefore becoming more competitive;

5. relève l'observation formulée par la Cour des comptes selon laquelle l'Institut ne dispose pas d'une procédure formalisée de planification et de suivi en matière de passation des marchés publics et que son programme de travail annuel ne contient pas de calendrier concernant les marchés publics liés aux activités planifiées; note toutefois que seuls 7 % des crédits engagés reportés à 2012 n'ont pas été utilisés et ont dû être annulés; souligne à cet égard que l'Institut s'est engagé à améliorer la planification et le suivi des marchés publics en mettant en place un instrument de suivi et des orientations en matière de suivi budgétaire; invite donc l'Institut à élaborer et mettre en œuvre une procédure formalisée de planification et de suivi en matière de passation des marchés publics et à inclure un calendrier concernant les marchés publics dans son programme de travail annuel;

Notes the comment of the Court of Auditors that the Institute does not have a formalised procurement planning and monitoring procedure and that its annual work programme does not include a procurement schedule linked to the planned activities; notes however that only 7 % of committed appropriations carried over to 2012 have not been used and had to be cancelled; underlines in this respect the Institute’s commitment to improve procurement planning and monitoring by creating a monitoring tool and budget monitoring guidelines; calls, therefore, on the Institute to develop and implement formalised procurement and monitoring procedures, and to incorporate a timetable for procurement into the annual work plan;
