Does Article 1[(1)](b) of Council Directive 2001/23/EC (1) of 12 March 2001, in conjunction with Article 4(1) thereof, preclude an interpretation of the Spanish legislation intended to give effect to the Directive, to the effect that a public-sector undertaking, responsible for a service central to its own activities and requiring important material resources, that has been providing that service by means of a public contract, requiring the contractor to use those resources which it owns, is not subject to the obligation to take over the rights and obligations relating to employment relationships when it decides not to extend the contract but to assume direct responsibility for its performance, using its own staff and thereby excluding the staff employed by the contractor, so that the service continues to be provided without any change other than that arising as a result of the replacement of the workers performing the activities and the fact that they are employed by a different employer?

The other point is that on the question of the airlines themselves having adequate internal responsibility for safety oversight, whether separate or merged, we think that the commercial motive, which they must keep in mind, needs to be matched by some external independent regulatory mechanisms and adequate public input mechanisms to avoid some of the kinds of problems that we have seen in other places in the world recently, notably in Britain in the rail industry, with respect to safety.

In light of the above considerations, in its decision-making practice the Commission has generally examined: (a) whether the original financing regime for public service broadcasters is existing aid in line with the rules indicated in paragraphs 26 and 27 above; (b) whether subsequent modifications affect the actual substance of the original measure (i.e. the nature of the advantage or the source of financing, the purpose of the aid, the beneficiaries or the scope of activities of the beneficiaries) or whether these modifications are rather of a purely formal or administrative nature; and (c) in case subsequent modifications are substantial, whether they are severable from the original measure, in which case they can be assessed separately, or whether they are not severable from the original measure so that the original measure is as a whole transformed into a new aid.

With regard to levels of radioactivity, in addition to the requirements of the standards, the main tasks of the Commission over five decades have concerned the application of Article 36 (collection and publication of data on levels of radioactivity to which the public is exposed as transmitted by Member States on the basis of measurement facilities established by them according to Article 35, first paragraph and Article 37 (Commission Opinions given on whether plans for the disposal of radioactive waste submitted by Member States are liable to affect other Member States).
