(63) Whereas the Community rules provide for the granting of export refunds on the sole basis of objective criteria, in particular as to the quantity, nature and characteristics of the product exported, and its geographical destination; whereas, in the light of experience, measures to combat irregularities and notably fraud harmful to the Community budget should be intensified; whereas, to that end, provision should be made for the recovery of amounts over-paid and sanctions to encourage exporters to comply with Community rules;

considérant qu'une telle incitation peut être obtenue, en premier lieu, par l'octroi d'une aide forfaitaire à la constitution de telles organisations, versée au terme de la première et de la seconde campagne de commercialisation qui suit la date de leur reconnaissance spécifique par l'État membre, et complémentaire de l'aide prévue à l'article 14 du règlement (CEE) no 1035/72 (2), modifié en dernier lieu par le règlement (CEE) no 2238/88 (3); qu'il convient de prévoir une participation financière de la Communauté à concurrence de 50 % de l'aide octroyée par l'État membre;
Whereas an incentive of this kind can be provided in the first instance by granting a flat-rate aid for the formation of these organizations which would be paid at the end of the first and second marketing year following the date of an organization's specific recognition by the appropriate Member State, and in addition to the aid provided for in Article 14 of Regulation (EEC) No 1035/72 (2), as last amended by Regulation (EEC) No 2238/88 (3); whereas provisions should be made for the Community to co-finance this scheme by paying 50 % of the aid granted by the Member State;

Whereas, in order to initiate action of this kind, some inducement should be offered to growers to relinquish their production, wholly or in part, of the three products in question ; whereas, for this purpose, Member States should be enabled to grant premiums to growers who, while agreeing to grub their orchards wholly or in part, undertake on the other hand not to replant their holding for a given period ; whereas the amount of the premium must be fixed at a level which takes account in particular of the cost of grubbing;
