4. Dans le cas des amendes, lorsque le débiteur constitue une garantie financière acceptée par le comptable en lieu et place d’un paiement, le taux d’intérêt applicable à compter de la date limite visée à l’article 80, paragraphe 3, point b), est le taux visé au paragraphe 2 du présent article qui est en vigueur le premier jour du mois au cours duquel a été arrêtée la décision imposant une amende, majoré seulement d’un point et demi de pourcentage.
4. In the case of fines, where the debtor provides a financial guarantee which is accepted by the accounting officer instead of payment, the interest rate applicable from the deadline referred to in Article 80(3)(b) shall be the rate referred to in paragraph 2 of this Article as in force on the first day of the month in which the decision imposing a fine has been adopted and increased only by one and a half percentage points.

En ce qui concerne les informations reçues en application du présent article, les référentiels centraux et l’AEMF respectent les conditions de confidentialité, d’intégrité et de protection des informations et se conforment aux obligations énoncées notamment dans le règlement (UE) nº 648/2012, article 80, les référentiels centraux étant passibles des amendes prévues à l’article 65 dudit règlement.

In respect of information received under this Article, trade repositories and ESMA shall respect the relevant conditions on confidentiality, integrity and protection of information and shall comply with the obligations set out in particular in Article 80 of Regulation (EU) No 648/2012, and be liable to the relevant fines set out in Article 65 of that Regulation.

Cet amendement permet de préciser que le titre alcoométrique maximal de 80 % s’applique aux boissons spiritueuses au point de vente et veille ainsi à ce que les boissons définies à l’annexe III présentant un taux de distillation supérieur à 80 % puissent continuer à être produites et à ce que l’Advocaat (catégorie 41), dont le titre alcoométrique est inférieur à 15 %, soit également pris en compte.
This is to clarify that the 80% alcohol limit applies to spirit drinks at the point of sale. And ensures that the drinks defined in Annex II that have a distillation level higher than 80% can continue to be produced and to provide for Advocaat (category 41) which has a minimum strength below 15%.
