(2) L'article 9 de la décision n° 406/2009/CE dispose que la Commission évalue les modalités de l'inclusion des émissions et des absorptions de gaz à effet de serre liées à l'utilisation des terres, au changement d'affectation des terres et à la foresterie dans l'engagement de réduction des émissions de gaz à effet de serre de l'Union, en garantissant la permanence et l'intégrité environnementale de la contribution du secteur et en assurant un suivi et une comptabilisation précis de ces émissions et absorptions. Il convient dès lors que la présente décision, dans un premier temps, définisse les règles comptables applicables aux émissions et aux absorptions de gaz à effet de serre résultant du secteur UTCATF. Il convient également, afin d'assurer dans l'intervalle la préservation et le développement des stocks de carbone, qu'elle prévoie que les États membres adoptent des plans d'action UTCATF définissant des mesures pour limiter ou réduire les émissions et pour entretenir ou renforcer l'absorption de gaz à effet de serre liées au secteur UTCATF.
(2) Article 9 of Decision No 406/2009/EC requires the Commission to assess modalities to include greenhouse gas emissions and removals resulting from activities related to land use, land use change and forestry into the Union’s greenhouse gas emission reduction commitment, whilst ensuring the permanence and environmental integrity of the contribution of the sector, and providing for accurate monitoring and accounting of the relevant emissions and removals. This Decision should, therefore, as a first step, set out accounting rules applicable to greenhouse gas emissions and removals from the LULUCF sector. To ensure the preservation and enhancement of carbon stocks in the interim, it should also provide for Member States to adopt LULUCF Action Plans setting out measures to limit or reduce emissions, and to maintain or increase removals, from the LULUCF sector.

(6) Il convient que les nouveaux critères et les critères établis par la décision 1999/476/CE soient valables simultanément pendant une période limitée à dix-huit mois afin que les sociétés qui ont obtenu ou demandé le label écologique pour leurs produits avant la date d'application de la présente décision disposent d'un délai suffisant pour mettre ces produits en conformité avec les nouveaux critères.

(15) Dans la mise en œuvre de la présente décision-cadre, les États membres respectent les droits fondamentaux et observent les principes reconnus en particulier par la Convention européenne de sauvegarde des droits de l'homme, notamment ses articles 9, 10 et 11, et par la Charte des droits fondamentaux de l'Union européenne, notamment ses chapitres II et VI. Par conséquent et compte tenu du principe de subsidiarité, les États membres doivent disposer d'une large marge d'appréciation dans la mise en œuvre et l'application de la présente décision-cadre.
(15) In implementing this Framework Decision, Member States must respect the fundamental rights and observe the principles recognised in particular by the European Convention on Human Rights, in particular Articles 9, 10 and 11 thereof, and by the Charter of Fundamental Rights of the European Union, and notably Chapters II and VI thereof. Accordingly and having regard to the principle of subsidiarity, Member States must have a wide margin of appreciation in implementing and applying this Framework Decision;
