104. Except in the cases set out in section 105, the holder of a Master, a Mate or an Engineer certificate that was issued before the day on which this section comes into force, that has not been renewed under these Regulations and that is set out in column 1 of Schedule 1 to this Part may obtain, in order to continue to have a certificate that is valid for use at sea and at the latest on the date of the expiry of the certificate, on application, an exchange of that certificate for one of the corresponding certificates set out in column 3 having, where applicable, the endorsement and limitation set out in column 4 of that item, and for that purpose the holder shall meet the requirements set out in column 2 of that item or paragraph, if any, and the requirements of section 106 or 107, as the case may be.

(24) Insofar as its provisions relate to SIS II as governed by Decision 2007/533/JHA, the United Kingdom is taking part in this Regulation, in accordance with Article 5(1) of the Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the TEU and to the TFEU, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis.

Insofar as its provisions relate to SIS II as governed by Regulation (EC) No 1987/2006 and to VIS, which constitute developments of provisions of the Schengen acquis in which the United Kingdom does not take part in accordance with Decision 2000/365/EC , the United Kingdom requested, by letter of 5 October 2010 to the President of the Council, to be authorised to take part in the adoption of this Regulation, in accordance with Article 4 of the Protocol on the Schengen acquis integrated into the framework of the European Union, annexed to the TEU and to the TFEU.

Pursuant to Article 15 of Directive 89/391/EEC, the employer shall adapt the measures referred to in this Article to the requirements of workers at particular risk and individual risks assessments as appropriate, in particular for workers who have declared the use of active or passive implanted medical devices (such as cardiac pacemakers), the use of body worn medical devices (such as insulin pumps) or women who have declared that they are pregnant, following the information as set out in Article 6 of this Directive.

Mr. Speaker, on a point of order, I move: That, notwithstanding any Standing Order or usual practice of the House, Bill C-45, in clause 321, be amended by adding after line 13 on page 291 the following: (2.1) The addition of the navigable waters listed below is deemed to be in the public interest and the Governor-in-Council shall, by regulation, as soon as is reasonably practicable after the day on which this act receives royal assent, add those navigable waters to the schedule, including, with respect to lakes, their approximate location in latitude and longitude and, with respect to rivers and riverines, the approximate downstream and upstream points, as well as a description of each of those lakes, rivers and riverines, and where more than one lake, river or riverine exists with the same name indicated in the list below, the Governor-in-Council shall select one to be added, namely: Natla Lake, Chartrand Lake, McDonald Lake, Hottah Lake, Moraine Lake, West Hans Lake, Bunting Lake, Grodsky Lake, Lake Bovie, Jennejohn Lake, Germaine Lake, Seven Islands Lake, Fallaize Lake, Fishing Bear Lake, Willowlake River.

Furthermore, insofar as its provisions relate to the provisions of Eurodac, by letter of 23 September 2009 to the President of the Council, the United Kingdom has notified its wish to take part in the adoption and application of this Regulation, in accordance with Article 3 of the Protocol on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice annexed to the TEU and the TFEU. The United Kingdom therefore takes part in the adoption of this Regulation, is bound by it and subject to its application.
