IN-CONTEXT TRANSLATIONS

Ces agences exécutives (ci-après dénommées «les agences») seront dotées de la personnalité juridique et d’un budget de fonctionnement propre dont l’exécution est régie par le présent règlement financier type, conformément à l’article 15 du règlement (CE) no 58/2003.
These executive agencies (hereinafter the agencies) will have legal personality and their own operating (i.e. administrative) budget, the implementation of which is governed by this standard financial regulation pursuant to Article 15 of Regulation (EC) No 58/2003.

(2) Afin de garantir une certaine homogénéité de cette réglementation par rapport au règlement (CE, Euratom) n°1605/2002 (ci-après dénommé "le règlement financier général") et en application des dispositions de l'article 185, paragraphe 1, de celui-ci, le présent règlement financier-cadre doit fixer les règles qui encadrent l'établissement, l'exécution et le contrôle du budget desdits organismes communautaires qui reçoivent effectivement une subvention à la charge du budget communautaire (ci-après dénommés "organismes communautaires").
(2) In order to guarantee a certain degree of consistency in these rules compared with Regulation (EC, Euratom) No 1605/2002 (hereinafter "the general Financial Regulation") and pursuant to Article 185(1) of that Regulation, this framework Financial Regulation must lay down the rules governing the establishment, implementation and scrutiny of the budget of the said Community bodies which actually receive grants charged to the Community budget (hereinafter "Community bodies").

(3) Comme le règlement financier général, le présent règlement financier-cadre se limite à l'énonciation des grands principes et règles de base régissant l'ensemble du domaine budgétaire concerné, tandis que des dispositions d'application pourront être ensuite adoptées par ces organismes, de manière à améliorer ainsi la lisibilité de leur réglementation financière.
(3) Like the general Financial Regulation, this framework Financial Regulation confines itself to stating the broad principles and basic rules governing the whole of the budgetary sector concerned, while detailed provisions may subsequently be adopted by these bodies in order to make their financial rules easier to read.

À ce titre, il peut être tenu de réparer en totalité le préjudice subi par les Communautés en raison de fautes personnelles graves qu'il aurait commises dans l'exercice ou à l'occasion de ses fonctions, en particulier lorsqu'il constate les droits à recouvrer ou émet les ordres de recouvrement, engage une dépense ou signe un ordre de paiement, sans se conformer au présent règlement financier et à ses modalités d'exécution.
Accordingly, he/she may be required to make good, in whole or in part, any damage suffered by the Communities as a result of serious misconduct on his/her part in the course of or in connection with the performance of his/her duties, in particular if he/she determines entitlements to be recovered or issues recovery orders, commits expenditure or signs a payment order without complying with this Financial Regulation and its implementing rules.

Les règles financières internes à ces organismes devront être adaptées, en conséquence, pour être compatibles avec le présent règlement financier.
The financial rules internal to these bodies will have to be adapted accordingly to be compatible with this Financial Regulation.

L'ordonnateur engage sa responsabilité pécuniaire dans les conditions du statut qui disposent que le fonctionnaire peut être tenu de réparer en totalité ou en partie le préjudice subi par les Communautés en raison de fautes personnelles graves qu'il aurait commises dans l'exercice ou à l'occasion de ses fonctions, en particulier lorsqu'il constate les droits à recouvrer ou émet les ordres de recouvrement, engage une dépense ou signe un ordre de paiement, sans se conformer au présent règlement financier et à ses modalités d'exécution.
1. The authorising officer shall be liable to payment of compensation as laid down in the Staff Regulations, which specify that an official may be required to make good, in whole or in part, any damage suffered by the Communities as a result of serious misconduct on his/her part in the course of or in connection with the performance of his/her duties, in particular if he/she determines entitlements to be recovered or issues recovery orders, commits expenditure or signs a payment order without complying with this Financial Regulation and its implementing rules.

"Les Représentants des Gouvernements des États réunis au sein du Conseil , constatent à l'occasion de l'adoption du présent règlement financier, que la fonction d'audit interne comporte des aspects nouveaux qui ne sont pas prévus expressément par le traité.
Re recital 19 1". The Representatives of the Governments of the States meeting within Council note on the occasion of the adoption of this Financial Regulation that the internal audit function involves new aspects which are not explicitly provided for in the Treaty.
