(3) Lorsqu’un contributeur a, sous le régime du présent règlement, acquis le droit à une pension ou allocation annuelle dont les mensualités s’élèveraient à moins de 10 $ chacune, on peut, s’il en fait la demande par écrit au ministre dans un délai de trois mois après avoir acquis ce droit, lui verser un montant déterminé d’après le paragraphe (4), qui sera la valeur capitalisée de ladite pension, lequel paiement doit tenir lieu de toute autre prestation prévue par le présent règlement.
(3) Where a contributor has become entitled under these Regulations to an annuity or an annual allowance the monthly instalments of which would amount to less than $10 each, there may be paid to that contributor, upon request by him to the Minister in writing within three months from the time when he became so entitled, an amount determined in accordance with subsection (4) to be the capitalized value of the said annuity, which payment shall be in lieu of any other benefit under these Regulations.

(9) This Regulation constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

(13) Le présent règlement constitue un développement des dispositions de l'acquis de Schengen auquel le Royaume-Uni ne participe pas conformément à la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et de l'Irlande du Nord de participer à certaines dispositions de l'acquis de Schengen; le Royaume-Uni ne participe donc pas à l'adoption du présent règlement et n'est pas lié par celui-ci, ni soumis à son application.

Nouvel article 10.1, Pierre de Savoye propose, Que le projet de loi C-27 soit modifié par adjonction, après la ligne 37, page 5, du nouvel article suivant : “ 10.1 (1) Le ministre peut prendre des décisions sur l'une ou l'autre des questions suivantes : a) la protection et le maintien des activités traditionnelles des populations ayant des droits acquis d'accès à un parc; b) lorsque les exigences de l'alinéa 5(1)a) relatives au droit de propriété ne sont pas remplies et qu'un parc comprend des terres devant faire l'objet d'un accord entre le ministre et le gouvernement autochtone, la nécessité de garantir que les activités traditionnelles des peuples autochtones ayant des droits acquis d'accès au parc sont reconnues et confirmées dans l'accord; c) les questions relatives aux terres situées dans un parc ou contiguës à celui-ci qui sont susceptibles d'entrer en conflit ou qui entrent en conflit avec la présente loi et les règlements applicables à ces terres; d) la mise en place d'une administration locale qui est représentative de la population de chaque parc.
New Clause 10.1, Pierre de Savoye moved, That Bill C-27 be amended by adding after line 29 on page 5 the following new clause: " 10.1 (1) The Minister may make a decision in respect of any one of the following matters: (a) the protection and preservation of the traditional activities of the populations having historic rights of access to the territory of a park; (b) if the requirements of paragraph 5(1)(a) in respect of title and right of ownership are not met and a park includes lands that require an agreement between the Minister and the aboriginal government, the need to ensure that the traditional activities of the aboriginal people having historic rights of access to the territory of the park are recognized and affirmed in the agreement; (c) all matters relating to the lands in or adjacent to a park that may be in or come into conflict with this Act and the regulations affecting those lands; and (d) the establishment of a local government that represents the populations of each park.

8. Dispositions générales a) Introduction d'un nouvel article pour préciser que les droits acquis par les O.P. en application du titre II bis (mesures spécifiques "fruits à coques") et de l'article 14 (aides au démarrage) du règlement (CEE) 1035/72 sont maintenus jusqu'à leur épuisement. b) L'article 14 sexties du règlement 1035/72 (dispositions relatives à la promotion des fruits à coques) est inséré dans le présent règlement dont l'article 51 paragraphe 1 est modifié en conséquence. c) Respect des contraintes budgétaires : "Tenant compte des modifications apportées à sa proposition initiale, la Commission veillera, lors de la mise en oeuvre des mesures dont la maîtrise des dépenses lui revient, à ce que le montant global des dépenses de la première année de la réforme respecte les contraintes budgétaires".
8. General provisions (a) Inclusion of a new Article specifying that rights acquired by POs under Title IIa (specific measures for nuts) and Article 14 (start-up aid) of Regulation (EEC) No 1035/72 continue to apply until fully utilized (b) Article 14e of Regulation 1035/72 (provisions concerning the promotion of nuts) has been inserted in this Regulation and Article 51(1) amended accordingly (c) Compliance with budgetary constraints: "Taking into account the amendments made to its original proposal, the Commission will ensure, when implementing the measures over which it has budgetary control, that overall spending in the first year of the reform complies with the budgetary constraints".
