STRESSING that under Danish law the courts in Denmark should — when interpreting this Agreement including the provisions of the Regulations and any implementing Community measures forming part of this Agreement — take due account of the rulings contained in the case-law of the Court of Justice of the European Communities and of the courts of the Member States of the European Communities in respect of provisions of the Regulations and any implementing Community measures.

Dans le cas présent, la Communauté a déjà exercé sa compétence dans ce domaine notamment en adoptant le règlement (CE) du Conseil n° 539/2001 du 15 mars 2001 fixant la liste des pays tiers dont les ressortissants sont soumis à l'obligation de visa pour franchir les frontières extérieures et la liste de ceux dont les ressortissants sont exemptés de cette obligation.
In the case in question, the Community has already exercised its competence in this field by adopting Council Regulation (EC) No 539/001 of 15 March 2001 listing the third countries whose nationals must be in possession of visas when crossing the external borders and those whose nationals are exempt from that requirement.
