Lorsqu’une question relative à la validité ou à l’interprétation du présent accord est soulevée dans une affaire en instance devant une juridiction ou un tribunal danois, cette juridiction ou ce tribunal demande à la Cour de justice de se prononcer chaque fois que, dans les mêmes circonstances, une juridiction ou un tribunal d’un autre État membre de l’Union européenne serait tenu de le faire au regard du «règlement Dublin II», du «règlement Eurodac» et de leurs mesures d’application visées à l’article 2, paragraphes 1 et 2.

Where a question on the validity or interpretation of this Agreement is raised in a case pending before a Danish court or tribunal, that court or tribunal shall request the Court of Justice to give a ruling thereon whenever under the same circumstances a court or tribunal of another Member State of the European Union would be required to do so in respect of the Dublin II Regulation and the Eurodac Regulation and their implementing measures referred to in Article 2(1) and 2(2).

Lorsqu’une question relative à la validité ou à l’interprétation du présent accord est soulevée dans une affaire en instance devant une juridiction danoise, cette juridiction demande à la Cour de justice de se prononcer sur cette question chaque fois que, dans les mêmes circonstances, une juridiction d’un autre État membre de l’Union européenne serait tenue de le faire à l’égard du règlement Bruxelles I et de ses dispositions d’exécution visées à l’article 2, paragraphe 1, du présent accord.

Where a question on the validity or interpretation of this Agreement is raised in a case pending before a Danish court or tribunal, that court or tribunal shall request the Court of Justice to give a ruling thereon whenever under the same circumstances a court or tribunal of another Member State of the European Union would be required to do so in respect of the Brussels I Regulation and its implementing measures referred to in Article 2(1) of this Agreement.

(1) Au cas où l’une ou l’autre des dispositions du présent accord serait impossible à exécuter ou serait par ailleurs remise en cause, et que le Canada et la Province seraient déchargés de son exécution, lesdites parties conviennent que le reste de l’accord demeure en vigueur et continue à lier les parties, ladite disposition devant être alors renégociée conformément aux modalités et aux conditions sur lesquelles les parties peuvent s’entendre et le Canada, de son propre chef et au nom de la Bande, ainsi que la Province, s’efforceront d’engager dans les plus brefs délais des négociations en vue de renégocier ladite disposition, en faisant le nécessaire pour que ces négociations parviennent à une conclusion rapide et satisfaisante pour tous.
(1) In the event that any provision of this Agreement becomes impossible of performance or is otherwise frustrated and Canada and the Province are thereby discharged from further performance of it, the said parties mutually agree that the remainder of the Agreement shall remain in full force and effect and be binding upon the said parties, and that the said provision shall be renegotiated upon such terms and conditions as may be mutually agreed upon, and that Canada, in its own right and on behalf of the Band, and the Province will proceed as soon as possible thereafter to enter into negotiations for the purpose of renegotiating the said provision and use their best endeavours to bring such negotiations to a mutually satisfactory and speedy conclusion.

A person who, but for this Agreement, would be subject to the legislation of both Parties in respect of employment as a member of the crew of a ship shall, in respect of that employment, be subject only to the legislation of Canada if he or she resides in the territory of Canada and only to the legislation of the Republic of Macedonia in any other case.

The respect for fundamental rights, privacy and data protection – e.g. article 1.4 on privacy and disclosure of information for instance states: "Nothing in this Agreement shall require any Party to disclose: . information the disclosure of which would be contrary to its law or its international agreements, including laws protecting right of privacy".

The intermediate option in addition to the 'Schengen Visa Centres' was introducing the concept of 'mandatory representation' according to which, if the Member State competent to process the visa application is neither present nor represented (under such an arrangement) in a given third country any other Member State present in that country would be obliged to process visa applications on their behalf.
