CONSIDÉRANT que la Cour de justice des Communautés européennes devrait avoir compétence pour garantir l’application et l’interprétation uniformes du présent accord y compris les dispositions des règlements et de toute mesure d’application de la Communauté faisant partie intégrante du présent accord,
STATING that the Court of Justice of the European Communities should have jurisdiction in order to secure the uniform application and interpretation of this Agreement including the provisions of the Regulations and any implementing Community measures forming part of this Agreement.

CONSIDÉRANT que le présent accord devrait entrer en vigueur le 1er janvier 2014 ou le premier jour du quatrième mois suivant celui du treizième dépôt, à condition que parmi les États membres contractants qui auront déposé leur instrument de ratification ou d'adhésion figurent les trois États dans lesquels le plus grand nombre de brevets européens étaient en vigueur au cours de l'année précédant celle au cours de laquelle intervient la signature de l'accord, ou le premier jour du quatrième mois après la date d'entrée en vigueur des modifications du règlement (UE) no 1215/2012 (2) portant sur le lien entre ce dernier et le présent accord, la date la plus tardive étant retenue,
CONSIDERING that this Agreement should enter into force on 1 January 2014 or on the first day of the fourth month after the 13th deposit, provided that the Contracting Member States that will have deposited their instruments of ratification or accession include the three States in which the highest number of European patents was in force in the year preceding the year in which the signature of the Agreement takes place, or on the first day of the fourth month after the date of entry into force of the amendments to Regulation (EU) No 1215/2012 (2) concerning its relationship with this Agreement, whichever is the latest,

CONSIDÉRANT que le présent accord devrait être ouvert à l'adhésion de tout État membre de l'Union européenne; les États membres qui ont décidé de ne pas participer à la coopération renforcée dans le domaine de la création d'une protection unitaire conférée par un brevet peuvent participer au présent accord pour ce qui concerne les brevets européens délivrés pour leur territoire respectif;
CONSIDERING that this Agreement should be open to accession by any Member State of the European Union; Member States which have decided not to participate in the enhanced cooperation in the area of the creation of unitary patent protection may participate in this Agreement in respect of European patents granted for their respective territory;

Ces consultations ont notamment pour but d'examiner si un éventuel futur système de dossiers passagers de l'UE appliquerait des critères de protection des données moins stricts que ceux prévus dans le présent accord, et si le présent accord devrait en conséquence être modifié.
Such consultations shall in particular examine whether any future EU PNR system would apply less stringent data protection standards than those provided for in this Agreement, and whether, therefore, this Agreement should be amended.

Le présent accord devrait s'entendre sans préjudice de l'autonomie décisionnelle de l'Union européenne et ne pas préjuger le caractère ponctuel de toute décision de l'Australie de participer à une opération de gestion de crise menée par l'Union européenne.
This Agreement should be without prejudice to the decision-making autonomy of the EU and should not prejudge the case-by-case nature of any decision by Australia to participate in an EU crisis management operation.

L’autorisation de modifier ou de conclure des accords bilatéraux d’investissement, prévue par le présent règlement, devrait permettre notamment aux États membres de remédier aux éventuelles incompatibilités existant entre leurs accords bilatéraux d’investissement et le droit de l’Union, autres que les incompatibilités découlant de la répartition des compétences entre l’Union et ses États membres, qui sont réglées par le présent règlement.
The authorisation to amend or conclude bilateral investment agreements provided for by this Regulation should notably allow Member States to address any incompatibilities between their bilateral investment agreements and Union law, other than incompatibilities arising from the allocation of competences between the Union and its Member States, which are addressed in this Regulation.

4. Rien dans le présent accord ne devrait être interprété comme une interdiction de refuser la remise d'une personne qui fait l'objet d'un mandat d'arrêt tel que défini par le présent accord s'il y a des raisons de croire, sur la base d'éléments objectifs, que ledit mandat a été émis dans le but de poursuivre ou de punir une personne en raison de son sexe, de sa race, de sa religion, de son origine ethnique, de sa nationalité, de sa langue, de ses opinions politiques ou de son orientation sexuelle, ou qu'il peut être porté atteinte à la situation de cette personne pour l'une de ces raisons.
4. Nothing in this Agreement should be interpreted as prohibiting refusal to surrender a person in respect of whom an arrest warrant as defined by this Agreement has been issued when there are reasons to believe, on the basis of objective elements, that the said arrest warrant has been issued for the purpose of prosecuting or punishing a person on the grounds of his or her sex, race, religion, ethnic origin, nationality, language, political opinions or sexual orientation, or that that person's position may be prejudiced for any of these reasons.

RECONNAISSANT que le présent accord devrait être remplacé par un accord d'association euro-méditerranéen dès que les conditions le permettront,
RECOGNIZING that this Agreement should be replaced by a Euro-Mediterranean Association Agreement as soon as conditions permit,
