At those meetings, an examination of the proposal for a directive of the European Parliament and of the Council recasting Directive 1999/45/EC of the European Parliament and of the Council of 31 May 1999 concerning the approximation of the laws, regulations and administrative provisions of the Member States relating to the classification, packaging and labelling of dangerous preparations resulted in the Consultative Working Party’s establishing by common accord that, as regards the explanatory memorandum accompanying the proposal, in order to be drafted in full compliance with the relevant requirements laid down by the Inter-institutional Agreement such a document should have stated the reasons for each proposed substantive amendment, as is provided for under point 6(a)(ii) of that agreement, and should have specified which provisions of the earlier act remain unchanged in the proposal, as is provided for under point 6(a)(iii).

8. Whereas the Mixed Committee, established pursuant to Article 3 of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the latters' association with the implementation, application, and development of the Schengen acquis(1), has been informed about the preparation of this Decision in accordance with Article 5 of that Agreement,

Highlights the need for the process under way to enjoy greater democratic legitimacy; calls for the means to be found of involving the European Parliament fully in the work to prepare and monitor the process in the run-up to the spring 2002 European Council and calls on the European Council to provide for the necessary amendments to the EC Treaty (Article 99(2)) during the next IGC; insists on being involved in the implementation of decisions through a form of codecision in the context of the broad economic policy guidelines, its implementation and monitoring, in so far as these are not contained in the guidelines; in order to guarantee the effectiveness of this control, the Commission will deliver to the EP, every six months, a report listing the different measures to be adopted, and an analysis of the state of play as regards implementation;
