Compte tenu du caractère évolutif de la phase précontentieuse tel qu’exposé précédemment, il convient toutefois d’observer que l’élaboration de l’acte fixant la position définitive de l’institution trouve son terme à l’occasion de l’adoption de la réponse faite par l’AHCC à la réclamation introduite par l’agent temporaire.
Bearing in mind the evolving nature of the pre-litigation stage as set out above, it should however be observed that the drawing up of the act laying down the institution’s definitive position comes to an end on the adoption of the response from the AECE to the complaint made by the temporary staff member.
