In the light of all (of) the foregoing considerations, it must be concluded that, by taking the view that the trade mark applied for was devoid of any distinctive character, the Board of Appeal misconstrued the wording of Article 7(1)(b) of Regulation No 40/94 from which it follows that a minimum degree of distinctive character is sufficient to render inapplicable the ground for refusal set out in that article (Case T-34/00 Eurocool Logistik v OHIM (EUROCOOL) [2002] ECR II‑683, paragraph 39.Grille, paragraphs 33 and 49; and Shape of a bottle, paragraph 42).

24. invite en outre les États membres, les autorités locales et les autorités scolaires à surveiller et à améliorer la qualité et les normes nutritionnelles des repas dans les écoles et dans les jardins d'enfants par le biais notamment de formations spécifiques et de consignes au personnel chargé de la restauration, en contrôlant la qualité des services de restauration et en établissant des orientations propres à assurer une alimentation saine dans les cantines; souligne à quel point il est important d'adapter le volume des portions offertes et de veiller à ce que les repas contiennent des fruits et des légumes; demande une intensification des efforts d'initiation à l'alimentation équilibrée et encourage l'abandon de la vente en distributeurs d'aliments et de boissons riches en graisses, en sels et en sucres dans les écoles; préconise en revanche un renforcement de l'offre de fruits et légumes frais aux points de vente; invite les autorités compétentes à garantir que trois heures par semaine au moins du programme scolaire sont consacrées aux activités physiques, conformément aux objectifs du livre blanc sur le sport précité, et leur demande de présenter des plans de construction de nouvelles infrastructures sportives publiques, accessibles aux handicapés, et de préservation des infrastructures sportives existantes dans les écoles; salue le lancement éventuel d'un projet "fruits à l'école" qui serait soutenu financièrement par l'Union européenne sur le modèle du programme actuel de distribution de lait dans les écoles; demande que des solutions soient trouvées afin de poursuivre la distribution gratuite de fruits et de légumes dans les écoles et les institutions caritatives en 2008, comme l'ont demandé certains États membres, dans l'attente de l'entrée en vigueur du programme de distributions de fruits à l'école le 1 janvier 2009;
24. Further, asks Member States, local entities and school authorities to monitor and to improve the quality and nutritional standards of school and kindergarten meals including by means of specific training and guidelines for catering staff, quality control of caterers and guidelines for healthy food in canteens; underlines the importance of adapting portion sizes to needs and including fruit and vegetables in these meals; asks for more nutrition education on a balanced diet and encourages a move away from the sale of foods and beverages high in fat, salt or sugar and of poor nutritional value in schools; advocates instead making fresh fruit and vegetables more available at points of sale; invites competent authorities to ensure that at least three hours a week of the school curriculum are devoted to physical activities, in accordance with the objectives of the above-mentioned White Paper on sport, and asks those authorities to provide plans for the construction of new public sports facilities, accessible also to disabled persons, and for the safeguarding of existing sports facilities in schools; welcomes a possible "fruit at school" project to be financially supported by the EU similar to the current school milk programme; calls for solutions to be found to continue the free distribution of fruit and vegetables to schools and charitable institutions during 2008 as requested by some Member States, pending the entry into application of the school fruit scheme on 1 January 2009;
