La Commission est consciente que le règlement proposé revêt d'une grande sensibilité juridique et politique, compte tenu des effets dommageables que pourrait avoir l'application pratique du régime proposé de "liste noire" pour les milieux professionnels concernés si les précautions nécessaires faisaient défaut, quant à la protection de leurs droits fondamentaux et à l'application des principes généraux du droit.
The Commission is aware that the proposed Regulation is highly sensitive both legally and politically in view of the damaging effects which applying a "black list" system could have for the trade sectors concerned in the absence of the necessary precautions regarding the protection of their basic rights and application of the general principles of law. The text now proposed to the Council therefore refers explicitly to the rights and principles which are to be respected.
