28. Takes note of the provisional application of a first economic partnership agreement (EPA) with a group of African countries; encourages the Commission to take stock of the lack of progress so far in concluding other EPAs which take full account of the development interests of DCs; calls on the Commission to harness this momentum in order to relaunch the ongoing negotiations on EPAs between the EU and interested DCs, in order to gradually integrate their markets in the multilateral trade framework; stresses the importance of establishing a firm and fair legal and commercial framework for promoting EU investment in ACP countries in a form that is mutually beneficial; calls on the Commission to take into account Parliament‘s recommendations concerning preference erosion and the flexibility and scope of tariff dismantling, and to pay particular attention to implementing the EPAs;

However, in a minority opinion one Member of the Panel concluded that the effects observed in certain studies raised uncertainties which may not be covered by the current TDI which should therefore be considered temporary until more robust data becomes available in the areas of uncertainty.

(14) La décision 97/131/CE du Conseil du 17 décembre 1996 concernant la conclusion d'un accord sous la forme d'un échange de lettres concernant l'application provisoire de l'accord entre la Communauté européenne et la Nouvelle-Zélande relatif aux mesures sanitaires applicables au commerce d'animaux vivants et des produits animaux(6) a approuvé un accord sous la forme d'un échange de lettres concernant l'application provisoire de l'accord, en vertu duquel, jusqu'à l'entrée en vigueur de l'accord, les conditions de certification applicables au 31 décembre 1996 doivent continuer à s'appliquer.
(14) Council Decision 97/131/CE of 17 December 1996 on the conclusion of an Agreement in the form of an Exchange of Letters concerning the provisional application of the Agreement between the European Community and New Zealand on sanitary measures applicable to trade in live animals and animal products(6) approved an agreement in the form of an exchange of letters concerning the provisional application of the Agreement, whereby, until the entry into force of the Agreement, the certification conditions applicable as at 31 December 1996 should continue to apply.

(3) Therefore, the Agreement has not entered into force and until it does the Agreement is provisionally applied as agreed by the Agreement in the form of an Exchange of Letters, attached to Council Decision 97/131/EC of 17 December 1996 on the conclusion of an Agreement in the form of an Exchange of Letters concerning the provisional application of the Agreement between the European Community and New Zealand on sanitary measures applicable to trade in live animals and animal products(3).

As to the first concern, the proposal uses a triple legal base: Article 170 (2) which is the standard article for research and development proposals; Article 300(2), first sentence of the first paragraph – which empowers the Commission to start negotiations and sign provisional acts until the entry into force, and allows the Council, acting by a qualified majority, to decide on the conclusion of the agreement – plus Article 300 (3), first subparagraph, which gives to the European Parliament the power of being consulted but that power is empty of essence because the EP has no right to amend the proposal.
