La première directive fille a pour objectif d'atteindre un niveau élevé de protection pour la santé humaine et pour l'environnement – contribuant ainsi à protéger deux droits fondamentaux cités dans la Charte des droits fondamentaux de l'UE, intégrée dans le projet de Constitution européenne.
The first daughter Directive aims at attaining a high level of protection with regard to human health and the environment – thereby contributing to the protection of two fundamental rights recognised by the EU Charter of rights that has been embedded in the draft EU Constitution.

Stresses that the role of the Commission as the guardian of the Treaties is not limited to ensuring that legislation is transposed by the Member States, but also extends to the full and correct application of laws, in particular with a view to protecting citizens’ fundamental rights; regrets the effective limitation of the scope of application of the Charter due to an excessively restrictive interpretation of its Article 51, read as preventing it from covering the enforcement of EU law; is of the opinion that this approach should be revised to meet EU citizens’ expectations in relation to their fundamental rights; recalls that the expectations of citizens go beyond the strict interpretation of the Charter and that the objective should be to render those rights as effective as possible; regrets, therefore, that the Commission pleads lack of competence in numerous replies to petitions complaining of a possible breach of fundamental rights; in this framework, calls for the establishment of a mechanism for the monitoring, systematic evaluation and issuing of recommendations, to foster overall compliance with fundamental values in the Member States;

Étant entendu que la responsabilité du contrôle et de la surveillance des frontières extérieures incombe aux États membres, l'Agence rend néanmoins plus facile et plus efficace l'application des dispositions existantes et futures de l'Union européenne en matière de gestion des frontières extérieures, notamment le code frontières Schengen, ainsi que de la charte des droits fondamentaux et de la Convention de Genève de 1951 relative au statut des réfugiés, dans le respect des dispositions pertinentes du droit de l'Union et du droit international, des obligations relatives à l'accès à la protection internationale et des droits fondamentaux, en assurant la coordination des actions des États membres lors de la mise en œuvre de ces dispositions, contribuant ainsi à l'efficacité, à la qualité et à l'uniformité du contrôle des personnes et de la surveillance des frontières extérieures des États membres de l'Union européenne, tout en appliquant les dispositions de la charte des droits fondamentaux, compte dûment tenu de la nécessité de respecter et de protéger les droits fondamentaux des migrants.
2. While considering that the responsibility for the control and surveillance of external borders lies with the Member States, the Agency shall facilitate and render more effective the application of existing and future European Union measures relating to the management of external borders, in particular the Schengen Borders Code, as well as of the Charter of Fundamental Rights and the Geneva Convention Relating to the Status of Refugees of 1951, and in accordance with relevant Union law, International law, obligations related to access to international protection, and fundamental rights. It shall do so by ensuring the coordination of Member States' actions in the implementation of those measures, thereby contributing to an efficient, high and uniform level of control on persons and surveillance of the external borders of the Member States while applying the provisions of the Charter of Fundamental Rights with due regard to respect for and the protection of the human rights of migrants.

Parce qu’à l’instar des archéologues qui déterrent progressivement de petites choses dans de petites excavations puis mettent toutes ces informations ensemble pour produire la carte d’une ville qui a été cachée et dont personne ne connaissait la localisation exacte, la Commission, avec le soutien inestimable d’autres personnes, d’ONG et du Conseil de l’Europe, entre autres, a réussi à dresser ce plan, à découvrir et mettre au jour cette ville cachée, qui est une stratégie conçue pour la violation systématique des droits fondamentaux des citoyens sous le prétexte théorique de protéger nos droits fondamentaux. Nous devons protéger nos droits et notre sécurité en violant les droits des autres: telle est l’approche que nous avons adoptée dans notre travail.
Because, just like archaeologists who gradually go on digging up small items through small excavations and then put all of that information together to produce a map of a city that had been hidden and the precise whereabouts of which nobody knew, the Commission, with the invaluable support of other people, of NGOs, in cooperation with the Council of Europe etc., has managed to draw up that map, to uncover and bring to light that hidden city, which is a plan designed for the systematic violation of the fundamental rights of the citizens on the theoretical premise of protecting our fundamental rights; we should protect our rights and our security by violating the rights of others. That is the approach our work has been taking.
