Le financement public de projets d’investissement en infrastructures est soumis aux règles de l’Union en matière d’aides d’État lorsque les infrastructures sont destinées à l'exploitation commerciale (voir l'arrêt du Tribunal de l'UE de mars 2011 dans les affaires jointes T-443/08 et T-455/08).
The public funding of infrastructure investment projects is subject to EU state aid rules when the infrastructure is to be operated commercially (see judgment of the EU General Court of March 2011 in Joined Cases T-443/08 and T-455/08).

En augmentant le niveau d'aide communautaire disponible et en se concentrant sur une liste de projets prêts à être lancés, elle garantira l'efficacité de l'intervention communautaire et stimulera les projets d'investissement transfrontaliers destinés à compléter et interconnecter les réseaux d'infrastructure nationaux. By increasing the level of Community support available and by focusing on a list of ready-to-launch projects, it will ensure the efficiency of the Community intervention and will boost cross-border investment projects to complete and interconnect national infrastructure networks.Greater integration of infrastructure networks will help to ensure higher traffic volume and more efficient utilisation of transport infrastructures and diminished congestion costs so that the expected return to investment for private investors will increase while giving rise to considerable gains in terms of economic efficiency, transportation time savings and environmental sustainability.
