1. By way of derogation from Article 3, the competent authority, as listed in Annex II, of the Member State where the exporter is established or, in the case that the exporter is not established within the Union, the Member State from which the equipment may be sold, supplied, transferred or exported, may authorise, under such conditions as it deems appropriate, the sale, supply, transfer or export of equipment as listed in point 4 of Annex I, where the equipment is solely for civilian use in mining or infrastructure projects.

The projects - known as "projects of common interest" have been chosen for support because they are considered to fulfil Community criteria of: * contributing to the achievement of a truly barrier-free energy market throughout the Union, by making possible new exchanges of energy and thus bringing aboutmore rationalised and therefore cheaper as well as dependable energy supplies for both industrial and private consumers; * contributing to more even development across the Union s regions, reducing the infrastructural disadvantages more particularly of the outermost, isolated, and otherwise disadvantaged areas (by bringing energy to new locations); * contributing to the security of the Community's overall energy supply, including by the resulting diversification of sources and available fuel mix , and by reinforcing energy links including those with third countries.
