The draft bill (if adopted) would see the establishment of a Competition Commission with responsibility for investigating and prosecuting anti-competitive practices falling under the scope of the competition bill, while the current broadcasting and telecommunications authorities would enjoy concurrent jurisdiction for matters relating to either of those distinct areas. The bill would also see the establishment of a Competition Tribunal.

La Grèce, l'Estonie, la Hongrie, le Luxembourg, Malte, les Pays-Bas et la Pologne ont correctement transposé le paragraphe 2. Ce serait également le cas du projet de loi chypriote, alors que les autres États membres évalués n'ont pas introduit de dispositions spécifiques aggravantes et n'ont pas recensé d'infractions ordinaires équivalentes qui permettraient de comparer les sanctions et donc d'évaluer la transposition.
Greece, Estonia, Hungary, Luxembourg, Malta, the Netherlands and Poland have implemented paragraph (2) properly – the Cypriot draft bill would also do so, while the other evaluated Member States have not introduced specific aggravating provisions nor have they identified equivalent ordinary offences which would allow a comparison of sanctions and therefore an assessment of implementation.
