J. considérant que la société civile égyptienne et les ONG internationales sont confrontées, dans le cadre de leurs activités en Égypte, à une pression croissante et à des difficultés majeures; considérant que le projet de loi sur les associations civiles et les fondations a suscité de vives inquiétudes parmi les militants et les organisations de la société civile, dans la mesure où ce projet de loi, s'il était adopté sous sa forme actuelle, placerait des pouvoirs discrétionnaires considérables aux mains du gouvernement en ce qui concerne les activités et le financement des groupes de la société civile; considérant que le projet de loi impose également des restrictions sur l'accès des groupes de la société civile à des financements étrangers, ce qui met en évidence le droit discrétionnaire de bloquer l'accès à de tels fonds en cas d'adoption d'une décision motivée du comité de coordination nouvellement créé;
J. whereas Egyptian civil society and international NGOs face mounting pressure and major difficulties in operating in Egypt; whereas the draft law on Civil Associations and Foundations has caused significant concern amongst civil society activists and organisations as the draft law in its present form would hand considerable discretionary power to the government over the activities and funding of civil society groups; whereas the draft law also imposes restrictions on civil society groups’ access to foreign funding, proving a discretionary right to block access to such funds on adoption of a justified decision by the newly formed Coordination Committee;

Les documents préparatoires transmis par les autorités françaises mentionnés dans le considérant 104 montrent d'ailleurs que le Conseil d'État était d'avis en 1997 que les dispositions de nature non-législative devaient être écartées du texte du projet de loi; en outre, un projet d'amendement au projet de loi du gouvernement visant à limiter les prélèvements que l'État pourrait effectuer sur EDF en vertu de la loi a lui aussi été écarté.
Furthermore, the preparatory documents submitted by the French authorities and referred to in recital 104 show that the Council of State took the view in 1997 that non-legislative provisions should be eliminated from the draft law; a draft amendment designed to limit the amounts that the state could collect from EDF under the Act was also rejected.

F. considérant que la loi égyptienne n° 84/2002, qui régit le fonctionnement et les activités des ONG, adoptée sous le régime de l'ancien président Moubarak, continue à être utilisée contre les organisations de la société civile en Égypte; que les attaques contre les bureaux des ONG et les jugements contre les employés de celles-ci font clairement ressortir l'urgence d'adopter une nouvelle loi et de nouvelles règles protégeant et encourageant les activités de la société civile dans le pays; que le président Morsi a envoyé le 29 mai 2013 au conseil de la Choura un nouveau projet de loi relatif aux ONG qui a suscité une vague de critiques; que cette loi, si elle était adoptée sous sa forme actuelle, renforcerait encore et institutionnaliserait le contrôle étatique sur la société civile en donnant des pouvoirs excessifs au gouvernement; que toute nouvelle loi sur les ONG devrait être élaborée en coopérant pleinement avec les acteurs de la société civile égyptienne, dans le plein respect des engagements et obligations du pays sur le plan international et en conformité avec les normes internationales;
F. whereas Egyptian Law 84/2002 regulating the functioning and activities of NGOs, adopted under the regime of former President Mubarak, continues to be used against civil society organisations in Egypt; whereas the raids on NGO offices, and the court sentences against NGO workers, are clear indications of an urgent need to adopt a new law and new regulations protecting and encouraging civil society activities in the country; whereas, on 29 May 2013, President Morsi sent to the Shoura Council a new draft law on NGOs that has provoked widespread criticism; whereas this law, if adopted in its current shape, would further strengthen and institutionalise state control over civil society by giving excessive powers to the government; whereas any new law on NGOs should be drafted in full cooperation with Egyptian civil society actors, must fully comply with the country’s international commitments and obligations, and should follow international standards;

B. considérant la décision annoncée par le gouvernement argentin de transmettre au Congrès argentin un projet de loi visant à valider l'expropriation de 51 % des actions de la compagnie pétrolière YPF, dont le capital était majoritairement détenu par une entreprise européenne, qui voit la plupart de ses actions faire l'objet de l'expropriation demandée;
B. whereas the government of the Argentine Republic has announced that it has decided to submit to the Argentine Congress a draft law confirming the expropriation of 51% of shares in the oil company YPF, a majority stake in which is held by a European undertaking, most of whose shares are the target of the proposed expropriation;

Pending the adoption of the draft law amending the Central Bank of Malta Act, legislation in Malta was considered not fully compatible with Article 109 of the Treaty and the ESCB Statute as regards central bank integration into the ESCB at the time of the adoption of the euro.
