Lorsque l’institution de l’État membre sous la législation duquel l’intéressé a exercé en dernier lieu une activité susceptible de provoquer la maladie professionnelle considérée constate que l’intéressé ou ses survivants ne satisfont pas aux conditions de cette législation, notamment parce que l’intéressé n’a jamais exercé dans ledit État membre une activité ayant causé la maladie professionnelle ou parce que cet État membre ne reconnaît pas le caractère professionnel de la maladie, ladite institution transmet sans délai à l’institution de l’État membre sous la législation duquel l’intéressé a exercé précédemment une activité susceptible de provoquer la maladie professionnelle considérée, la déclaration ou la notification et toutes les pièces qui l’accompagnent, y compris les constatations et rapports des expertises médicales auxquelles la première institution a procédé.
2. Where the institution of the last Member State under the legislation of which the person concerned pursued an activity likely to cause the occupational disease in question establishes that the person concerned or his survivors do not meet the requirements of that legislation, inter alia, because the person concerned had never pursued in that Member State an activity which caused the occupational disease or because that Member State does not recognise the occupational nature of the disease, that institution shall forward without delay the declaration or notification and all accompanying certificates, including the findings and reports of medical examinations performed by the first institution to the institution of the previous Member State under the legislation of which the person concerned pursued an activity likely to cause the occupational disease in question.

Lorsque l’institution à laquelle la déclaration ou la notification a été transmise constate qu’une activité susceptible de provoquer la maladie professionnelle considérée a été exercée en dernier lieu sous la législation d’un autre État membre, elle transmet la déclaration ou la notification ainsi que toutes les pièces qui l’accompagnent à l’institution correspondante de cet État membre.
When the institution to which the declaration or notification was sent establishes that an activity likely to cause the occupational disease in question was last pursued under the legislation of another Member State, it shall send the declaration or notification and all accompanying certificates to the equivalent institution in that Member State.

S’il est établi qu’il s’agit d’un accident du travail ou d’une maladie professionnelle, les prestations en nature dont l’intéressé a bénéficié au titre de l’assurance maladie sont considérées depuis la date de l’accident du travail ou de la première constatation médicale de la maladie professionnelle comme des prestations d’accident du travail ou de maladie professionnelle.
Where an accident at work or occupational disease is established, sickness benefits in kind provided to the person concerned shall be considered as accident at work or occupational disease benefits from the date on which the accident at work occurred or the occupational disease was first medically diagnosed.

Where the institution of the last Member State under the legislation of which the victim pursued an activity likely to cause the occupational disease in question establishes that the victim or his/her survivors do not meet the requirements of that legislation, that institution shall forward immediately to the institution of the previous Member State under the legislation of which the victim pursued an activity likely to cause the occupational disease in question the declaration and all accompanying certificates, including the findings and reports of medical examinations performed by the first institution, as well as a copy of the decision referred to in the second paragraph.

Si cette dernière institution constate qu'une activité susceptible de provoquer la maladie professionnelle considérée a été exercée en dernier lieu sous la législation d'un autre État membre, elle transmet la déclaration et les pièces qui l'accompagnent à l'institution correspondante de cet État membre.
If the latter institution establishes that an activity likely to cause the occupational disease in question was last pursued under the legislation of another Member State, it shall send the declaration and the accompanying certificates to the equivalent institution in that Member State.
