2. By way of derogation from paragraph 1, for each authorised plant protection product containing Candida oleophila strain O as either the only active substance or as one of several active substances, all of which were listed in the Annex to Implementing Regulation (EU) No 540/2011 by 30 September 2013 at the latest, Member States shall re-evaluate the product in accordance with the uniform principles, as referred to in Article 29(6) of Regulation (EC) No 1107/2009, on the basis of a dossier satisfying the requirements of Annex III to Directive 91/414/EEC and taking into account the column on specific provisions of Annex I to this Regulation.

2. Par dérogation au paragraphe 1, tout produit phytopharmaceutique autorisé contenant du tébufénozide en tant que substance active unique ou associée à d’autres substances actives, toutes inscrites à l’annexe I de la directive 91/414/CEE au plus tard le 31 mai 2011, fait l’objet d’une réévaluation par les États membres, conformément aux principes uniformes prévus à l’annexe VI de ladite directive, sur la base d’un dossier satisfaisant aux exigences de son annexe III et tenant compte de la partie B de l’inscription concernant le tébufénozide à son annexe I. By way of derogation from paragraph 1, for each authorised plant protection product containing tebufenozide as either the only active substance or as one of several active substances all of which were listed in Annex I to Directive 91/414/EEC by 31 May 2011 at the latest, Member States shall re-evaluate the product in accordance with the uniform principles provided for in Annex VI to Directive 91/414/EEC, on the basis of a dossier satisfying the requirements of Annex III to that Directive and taking into account part B of the entry in Annex I to that Directive concerning tebufenozide. On the basis of that evaluation, they shall determine whether the product satisfies the conditions set out in Article 4(1)(b), (c), (d) and (e) of Directive 91/414/EEC.

On the basis of that evaluation, they shall determine whether the product satisfies the conditions set out in Article 4(1)(b), (c), (d) and (e) of Directive 91/414/EEC.

En fonction de cette évaluation, les États membres déterminent si le produit remplit les conditions énoncées à l’article 4, paragraphe 1, points b), c), d) et e), de la directive 91/414/CEE.

By way of derogation from paragraph 1, for each authorised plant protection product containing zinc phosphide as either the only active substance or as one of several active substances all of which were listed in Annex I to Directive 91/414/EEC by 30 April 2011 at the latest, Member States shall re-evaluate the product in accordance with the uniform principles provided for in Annex VI to Directive 91/414/EEC, on the basis of a dossier satisfying the requirements of Annex III to that Directive and taking into account part B of the entry in Annex I to that Directive concerning zinc phosphide. On the basis of that evaluation, they shall determine whether the product satisfies the conditions set out in Article 4(1)(b), (c), (d) and (e) of Directive 91/414/EEC.

2. Par dérogation à l’article 36, paragraphe 2, un État membre peut également, dans des cas exceptionnels, appliquer les dispositions prévues au paragraphe 1 du présent article lors de l’examen de toute demande d’autorisation relative à un produit phytopharmaceutique ne contenant aucune substance dont on envisage la substitution ni de substance active à faible risque, s’il existe une méthode non chimique de prévention ou de lutte pour la même utilisation et si elle est d’usage courant dans cet État membre.

By way of derogation from Article 36(2) Member States may in exceptional cases also apply the provisions of paragraph 1 of this Article when evaluating an application for authorisation of a plant protection product not containing a candidate for substitution or a low-risk active substance, if a non-chemical control or prevention method exists for the same use and it is in general use in that Member State.

1. Member States shall not prohibit placing on the market and use of seeds treated with plant protection products authorised for that use in at least one Member State.
