PRINCIPES FONDAMENTAUX Pour appliquer l'article 92 paragraphe 3 point c) et l'article 61 paragraphe 3 point c) de l'accord EEE dans le contexte sectoriel de l'aviation, la Commission a fixé certains critères à remplir qui sont, en résumé, les suivants : (1) l'aide doit faire partie d'un programme global de restructuration, permettant à la compagnie de redevenir viable sans aide supplémentaire; (2) l'aide sera la dernière en conformité avec le droit communautaire; cela signifie qu'une compagnie aérienne ayant bénéficié d'une aide ne sera pas autorisée à en recevoir d'autres à moins de circonstances exceptionnelles, imprévisibles et en dehors du contrôle de l'entreprise ; (3) des réductions de capacité doivent être prévues si nécessaire; (4) en tout état de cause, l'aide et le programme y afférent ne doivent pas viser à augmenter la capacité au détriment d'autres transporteurs de l'EEE; (5) le gouvernement ne doit pas s'immiscer dans la gestion de la compagnie pour des raisons non commerciales; (6) l'aide ne doit être utilisée qu'aux fins du programme de restructuration et ne pas être disproportionnée par rapport aux besoins de ce programme.
FUNDAMENTAL PRINCIPLES For the application of Article 92(3)(c) of the Treaty and Article 61(3)(c) of the EEA Agreement in the sectoral context of aviation, the Commission has defined certain criteria which have to be met. In short: (1) the aid shall be part of a comprehensive restructuration programme enabling the company to regain viability without further aid; (2) the aid shall be the last one in conformity with Community law; this implies that an air carrier having received aid, will not be allowed further aid unless under exceptional circumstances, unforeseeable and external to the company (3) capacity reductions have to be included, if necessary; (4) the aid and the related programme do not in any case aim at increasing capacity to the detriment of other EEA carriers; (5) the Government must not interfere in the management of the company for non commercial reasons; (6) The aid must only be used for the purposes of the restructuring programme and must not be disproportioned to its needs.
