J. considérant que, lorsque la Communauté détient une compétence législative, la façon correcte de procéder passe par l'adoption d'un acte législatif par les institutions démocratiques de l'Union, le Parlement européen et le Conseil, dans la mesure où cela apparaît nécessaire eu égard aux principes de subsidiarité et de proportionnalité; que ce n'est que grâce à l'adoption de textes législatifs par le recours aux procédures institutionnelles prévues par le traité que la sécurité juridique, l'état de droit, le contrôle juridictionnel et le caractère exécutoire peuvent être garantis; qu'il en résulte également le respect de l'équilibre institutionnel inscrit dans le traité et que cela permet la transparence du processus décisionnel,
J. whereas where the Community has legislative competence, the proper way to act is through the adoption of legislation by the democratic institutions of the Union, Parliament and the Council, in so far as this still appears necessary having due regard to the principles of subsidiarity and proportionality; whereas it is only by means of the adoption of legislation through the institutional procedures laid down in the Treaty that legal certainty, the rule of law, justiciability and enforceability may be secured, and whereas this also entails respect for the institutional balance enshrined in the Treaty and allows for openness of decision-making,
