L’article 4 du règlement (CE) no 1346/2000 du Conseil, du 29 mai 2000, relatif aux procédures d’insolvabilité doit être interprété en ce sens que relève de son champ d’application une action dirigée contre le dirigeant d’une société de droit anglais ou gallois, faisant l’objet d’une procédure d’insolvabilité ouverte en Allemagne, intentée devant une juridiction allemande par le curateur de cette société et tendant, sur le fondement d’une disposition nationale telle que l’article 64, paragraphe 2, première phrase, de la loi relative aux sociétés à responsabilité limitée, au remboursement de paiements effectués par ce dirigeant avant l’ouverture de la procédure d’insolvabilité, mais après la date à laquelle la survenance de l’insolvabilité de cette société a été fixée.
