Each Member State should nominate three candidates for the position of European Prosecutor to be selected and appointed by the Council.

Lorsqu’une mesure doit être prise dans un État membre autre que l’État membre du procureur européen délégué chargé de l’affaire, ce dernier se prononce sur l’adoption de la mesure nécessaire et délègue celle-ci à un procureur européen délégué situé dans l’État membre dans lequel la mesure doit être exécutée.
Where a measure needs to be undertaken in a Member State other than the Member State of the handling European Delegated Prosecutor, the latter European Delegated Prosecutor shall decide on the adoption of the necessary measure and assign it to a European Delegated Prosecutor located in the Member State where the measure needs to be carried out.

A case shall as a rule be initiated and handled by a European Delegated Prosecutor from the Member State where the focus of the criminal activity is or, if several connected offences within the competences of the EPPO have been committed, the Member State where the bulk of the offences has been committed.

3. Calls at the present time on the Convention and in due course on the 2004 Intergovernmental Conference, i.e. on the governments of the Member States to ensure that the forthcoming institutional reform actually includes the establishment of a European Public Prosecutor’s office through incorporation of the Article 280a which has been proposed by the Commission and which covers the essential points pertaining to the office of European Prosecutor (appointment, dismissal, duties and independence) and which refers to the rules (to be laid down under secondary legislation) which are needed in order to enable the Prosecutor to perform his/her tasks;

the appointment of an independent European Public Prosecutor assisted by Deputy European Public Prosecutors in each Member State, which would provide the structure of a European Public Prosecutor's Office as advocated in the 'Corpus Juris' expert report, to which should be added a European body responsible for overseeing the work of the Prosecutor's Office and taking committal decisions, in accordance with the judicial safeguard principle;

Monsieur VITORINO, Commissaire chargé de la justice et des affaires intérieures, ajoute en conclusion : "La réalisation des objectifs définis dans la stratégie de la Commission permettra de constituer un acquis sur lequel pourra s'appuyer la perspective d'un procureur européen chargé de la protection des intérêts financiers des communautés".
Mr VITORINO, Commissioner responsible for justice and internal affairs, adds: "Carrying out the objectives defined in the Commission's strategy will allow development of an acquis on which a future European judicial body will in time be able to rely for the protection of Community's financial interests".
