An important test case is coming now with the nomination of a new Chief Prosecutor for the Directorate for Investigation of Organised Crime and Terrorism (DIICOT), following the resignation of the Chief Prosecutor in November.[6] The procedure includes a strong political element in terms of the role it gives to the Minister of Justice.[7] The Superior Council of the Magistracy (SCM) is working on an amendment to the law to change this, and to align appointment of prosecutors on the procedures used for judges, in line with the guidance of the European Commission for Democracy through Law of the Council of Europe (Venice Commission):[8] if this were to be pursued, the next step would be for the government to propose this to Parliament.

Following the publication of a notice of impending expiry (1) of the anti-dumping measures in force on imports of urea originating in Russia (‘the country concerned’), the Commission has received a request for review pursuant to Article 11(2) and (3) of Council Regulation (EC) No 384/96 on protection against dumped imports from countries not members of the European Community (‘the basic Regulation’) (2), as last amended by Council Regulation (EC) No 2117/2005 (3).

Pursuant to Recommendation 19 in the 2000 action plan entitled ‘The prevention and control of organised crime: a European Union strategy for the beginning of the new millennium’, which was approved by the Council on 27 March 2000 (3), an examination should be made of the possible need for an instrument which, taking into account best practice in the Member States and with due respect for fundamental legal principles, introduces the possibility of mitigating, under criminal, civil or fiscal law, as appropriate, the onus of proof regarding the source of assets held by a person convicted of an offence related to organised crime.
