Le mandat de privatisation ayant cependant prévu la vente de l’ensemble des participations de ÖIAG, cette dernière n’aurait pu vendre ses parts du capital d’Austrian Airlines qu’en raison de la structure de l’opération (une fondation privée enregistrée en Autriche) proposée par tous les offrants, tout en conservant les précieux droits de trafic en question, et effectuer la privatisation complète.
However, as the privatisation mandate provided for the divestiture of all of ÖIAG’s shares, it was only on the basis of the transaction structure proposed by all bidders (an Austrian registered private foundation) that ÖIAG was able to sell its shares in Austrian Airlines while retaining, for the airline, the valuable traffic rights in question and carrying out a complete privatisation.
