L'approbation de nouveaux principes uniformes intervient suite à l'annulation par la Cour de Justice, le 18 juin 1996, de la directive 94/43/CE après qu'un recours a été formé par le Parlement contre le Conseil au motif que ladite directive modifiait la portée de la directive de base (91/414/CEE) sans recourir à la procédure législative prescrite par le traité qui implique la consultation du Parlement.
The approval of the new uniform principles follows the annulment by the Court of Justice, on 18 June 1996, of Directive 94/43/EC after the Parliament brought proceedings against the Council on the grounds that the Directive modified the scope of the basic Directive (91/414/EEC) without following the legislative procedure laid down by the Treaty, which involves consultation of the Parliament.
