Au sujet des paiements de NG à IPC (mesure 6), la Commission prend acte du constat de la Cour des comptes du Land de Rhénanie-Palatinat selon lequel un
commerçant faisant preuve de diligence n'aurait pas choisi les entreprises concernées pour la prestation de services et NG n'a pas examiné les activités antérieures de ces entreprises avec la diligence requise pour déterminer si elles possédaient les aptitudes nécessaires et si les conditions qu'elles proposaient pour le financement du projet Nürburgring 2009 étaient réalistes (160). Dans ce contexte, la Commission estime qu'un avantage a été procuré aux entreprises du fait du choix d'IPC

Concerning the consideration paid by NG to IPC (measure 6), the Commission notes that the Land's Court of Auditors found that a prudent entrepreneur would not choose those particular companies for the provision of services, and that NG did not check with the necessary prudence the previous work of those companies, in order to assess their appropriateness and to examine whether the conditions for the financing of the Nürburgring 2009 project offered by them were realistic (160). In this context, the Commission considers that the choice of IPC for the provision of those particular services conferred an advantage to those companies.
