Unless otherwise provided for in the implementing Regulation, where a person is eligible for a benefit, or is liable to pay a contribution in accordance with the basic Regulation, and the competent institution does not have all the information concerning the situation in another Member State which is necessary to calculate definitively the amount of that benefit or contribution, that institution shall, on request of the person concerned, award this benefit or calculate this contribution on a provisional basis, if such a calculation is possible on the basis of the information at the disposal of that institution.

(a) where the relevant financial support order provides only for a lump sum payment, the amount specified in the order shall first be satisfied out of the lump sum portion of the recipient’s net pension benefit in accordance with section 36 of the Act as if the recipient’s pension benefit consisted only of a lump sum payment and, if any amount thereof remains unsatisfied, that amount shall be treated as a new lump sum payment to be satisfied in accordance with section 37 of the Act as if the recipient’s pension benefit consisted only of periodic payments;

La présente directive ne devrait pas affecter les conditions de travail et d'emploi qui, conformément à la directive 96/71/CE du Parlement européen et du Conseil du 16 décembre 1996 concernant le détachement de travailleurs effectué dans le cadre d'une prestation de services , s'appliquent aux travailleurs détachés dans le cadre d'une prestation de service sur le territoire d'un autre État membre.
This Directive should not affect terms and conditions of employment which, pursuant to Directive 96/71/ECof the European Parliament and of the Council of 16 December 1996 concerning the posting of workers in the framework of the provision of services , apply to workers posted to provide a service in the territory of another Member State.

4. Lorsque le calcul effectué dans un seul État membre conformément au paragraphe 1, point a), a toujours pour résultat que la prestation autonome est égale ou supérieure à la prestation au prorata, calculée conformément au paragraphe 1, point b), l'institution compétente peut renoncer au calcul au prorata, selon les conditions prévues dans le règlement d'application.
4. Where the calculation pursuant to subparagraph 1(a) in one Member State invariably results in the independent benefit being equal to or higher than the pro rata benefit, calculated in accordance with subparagraph 1(b), the competent institution may waive the pro rata calculation, under the conditions provided for in the Implementing Regulation.
