Les États membres dont les autorités compétentes signent les documents visés au premier alinéa en utilisant d’autres formats de signature électronique que ceux visés audit alinéa notifient à la Commission les possibilités de validation existantes permettant aux autres États membres de valider en ligne, gratuitement et sans que la connaissance de la langue native soit nécessaire, les signatures électroniques reçues, sauf si les informations requises sont incluses dans le document, dans la signature électronique ou dans le support électronique du document.
2. Member States whose competent authorities sign the documents referred to in paragraph 1 using other formats of electronic signatures than those referred to in that same paragraph, shall notify to the Commission existing validation possibilities that allow other Member States to validate the received electronic signatures online, free of charge and in a way that is understandable for non-native speakers unless the required information is already included in the document, in the electronic signature or in the electronic document carrier.

Pending its entry into force, the Agreement shall be applied on a provisional basis by the Union and by the Member States from the first day of the month following the earliest of: (i) the date of the last note by which the Contracting Parties notify each other of the completion of the procedures necessary to provisionally apply the Agreement, or (ii) subject to the internal procedures and/or domestic legislation, as applicable, of the Contracting Parties, the date that falls 12 months from the date of signature of the Agreement.

This form of signature needs first to be uniquely linked to the signatory, secondly it needs to be capable to identify the signatory, thirdly the means need to be such that they can be maintained under the whole control of the signatory and fourthly it needs to be linked to the data in such a way that any subsequent change in the data can be detected (see Article 2.2 of the Directive). The third form, a “qualified electronic signature” ( QES ) consists of an advanced electronic signature based on a qualified certificate ( QC ) and created by a secure-signature-creation device.
